Councilman Armstrong opposed accepting the recommendation because of the fact that the county taxes were paid and not the city's. City Collector Miramontes advised that if the recommendation were not accepted, it would be necessary to file a Mcpnerney Suit, pay the county taxes and buy the sewer bonds from Mr. Weiner. She said the Real Estate Committee felt it was the best amount of money that could be realized from these lots. Councilman Granger moved the matter be carried on the agenda, seconded by Councilman McNulty. Motion passed unanimously. Councilman Granger stated that some time ago Mr. Weiner had put up some money to guarantee paving of a street in the Lenolt Tract. Street Superin- tendent Winter advised that this street had been paved about two years ago. This was the time set for hearing of protests on assessment roll of Resolution of Intention No. 1945-2. There were no protestants. WHEREAS, the assessment for sidewalks and other street work done under that certain contract dated June 4th, 1945, by and between M. WEBER, first party, and H. L. WINTER, as Superintendent of Streets of the City of'Redwood City, second party, for the doing of all sidewalks and other street work mentioned and described in Resolution of Intention No. 1945-2, passed and adopted by the Council of the City of Redwood City on the 5th day of March, 1945, and now on file in the office of the Clerk of said City, to which Resolution of Intention reference is hereby made for a description of said work, was filed in the office of the Clerk of the City. of Redwood City on the 18th day of January, 1946; and WHEREAS, said City Clerk did thereupon fix Monday, the 4th day of February, 1946, at the hour 8:00 o'clock P.M. of said day, at the meeting place of the Council of the City of Redwood City do the Council Chamber in the City Hall on Middlefield Road in the City of Redwood City as the time and place for a hearing on said assessment, as required by law, and as the time and place for making written objections thereto, as provided for, in Ordinance No. 333`of the City -of Redwood City; and WHEREAS, Notice of Filing of said°assessment of the time fixed for hearing thereon was duly given by posting, publishing and mailing as re- quired by law, as appears from the affidavits of RALPH S. DODGE, LOUISE WHITE and now on file in the office of the Clerk of said City of Redwood City; and WHEREAS, at the time and place last herein'mentioned, no objections of any kind were wade against said assessment; and WHEREAS, said Council of the City of Redwood City has now acquired juriedictibn thereon; THEREFORE BE IT RESOLVED By the Council of the Oity of Red.piood City, in the County of San Mateo, State of California, that the.assessment above mentioned'for sidewalks and other street work done under Resolution of Intention No. 1945-2 hereinbefore referred to herein, be and the same is hereby approved and adopted and the Superintendent of Streets of said City of Redwood City is hereby directed to attach a warrant thereto and deliver same to the contractor, as required by law.
