Councilman Armstrong opposed accepting the <br />recommendation because of the fact that the county taxes were paid and not <br />the city's. City Collector Miramontes advised that if the recommendation <br />were not accepted, it would be necessary to file a Mcpnerney Suit, pay the <br />county taxes and buy the sewer bonds from Mr. Weiner. She said the Real <br />Estate Committee felt it was the best amount of money that could be realized <br />from these lots. Councilman Granger moved the matter be carried on the <br />agenda, seconded by Councilman McNulty. Motion passed unanimously. <br />Councilman Granger stated that some time ago Mr. Weiner had put up some <br />money to guarantee paving of a street in the Lenolt Tract. Street Superin- <br />tendent Winter advised that this street had been paved about two years ago. <br />This was the time set for hearing of protests on assessment roll of Resolution <br />of Intention No. 1945-2. There were no protestants. Councilman Fletcher <br />moved, seconded by Councilman Mc Nulty, filing of affidavits of publication <br />of notice in the, official -.paper, :affidavits of: -,FV S.'.Dodgeethat he;;post.ed <br />notice on January 30 and kept it posted until this date and affidavit of <br />Louise White of notices sent to every property owner to be assessed. <br />Motion passed unanimously. <br />Councilman Britechgi offered resolution and moved its adoption confirming the <br />street assessment on project known as Resolution of Intention No. 1945-2, <br />seconded by Councilman Armstrong. On roll call resolution passed unani- <br />mously with Councilman Anderson absent. <br />RESOLUTION No. 269 <br />RESOLUTION CONFIRMING STREET ASSESSMENT NO. 1945-2. <br />WHEREAS, the assessment for sidewalks and other street work done under <br />that certain contract dated June 4th, 1945, by and between M. WEBER, first <br />party, and H. L. WINTER, as Superintendent of Streets of the City of'Redwood <br />City, second party, for the doing of all sidewalks and other street work <br />mentioned and described in Resolution of Intention No. 1945-2, passed and <br />adopted by the Council of the City of Redwood City on the 5th day of March, <br />1945, and now on file in the office of the Clerk of said City, to which <br />Resolution of Intention reference is hereby made for a description of said <br />work, was filed in the office of the Clerk of the City. of Redwood City on <br />the 18th day of January, 1946; and <br />WHEREAS, said City Clerk did thereupon fix Monday, the 4th day of <br />February, 1946, at the hour 8:00 o'clock P.M. of said day, at the meeting <br />place of the Council of the City of Redwood City do the Council Chamber in <br />the City Hall on Middlefield Road in the City of Redwood City as the time <br />and place for a hearing on said assessment, as required by law, and as the <br />time and place for making written objections thereto, as provided for, in <br />Ordinance No. 333`of the City -of Redwood City; and <br />WHEREAS, Notice of Filing of said°assessment of the time fixed for <br />hearing thereon was duly given by posting, publishing and mailing as re- <br />quired by law, as appears from the affidavits of RALPH S. DODGE, LOUISE <br />WHITE and <br />now on file in the office of the Clerk of said City of Redwood City; and <br />WHEREAS, at the time and place last herein'mentioned, no objections <br />of any kind were wade against said assessment; and <br />WHEREAS, said Council of the City of Redwood City has now acquired <br />juriedictibn thereon; <br />THEREFORE BE IT RESOLVED By the Council of the Oity of Red.piood City, <br />in the County of San Mateo, State of California, that the.assessment above <br />mentioned'for sidewalks and other street work done under Resolution of <br />Intention No. 1945-2 hereinbefore referred to herein, be and the same is <br />hereby approved and adopted and the Superintendent of Streets of said City <br />of Redwood City is hereby directed to attach a warrant thereto and deliver <br />same to the contractor, as required by law. <br />Passed and adopted by'the Council of the City of Redwood City at a <br />(pt), <br />Ma <br />it <br />
