The motion passed unanimously. <br />' <br />City Attorney McCarthy reported that the subdividers of Broadway No. j had <br />II <br />inauired whether if the owner of the front portion of the property bought <br />the rear portion it would be construed as being within the terms of the <br />contract or whether the city would require the deposit to cover public <br />improvements. He said -if the rear property were sold to anyone other <br />than the owner of the front property the terms of the contract would be <br />applicable,: Councilman Anderson expressed the opinion that he dX,d.not <br />believe it would be wise to allow•this concession, stating that if a'; <br />' <br />person buys an entire lot he is under the terms of the contract and not <br />if he busy only a portion of a lot. It was the general coneensus of the <br />Council that the terms of 'the Contract should be ahered to in all cases. <br />City Manager Mead reported that he had a report from Fire Chief Ryan, Building <br />Inspector Duncan and Health -Inspector Stein in regard to violations at <br />the old Harder Ranch. He advised that he had asked City Attorney McCarthy <br />to institute-abatement•proceedings against this property and it would be <br />' <br />on the agenda of the next meeting. <br />Councilman Armstrong asked City Manager Mead about the trees growing in the <br />1000 and.1100 Block on Brewster Avenue. City Manager Mead advised he <br />would have them inspected and trimmed. <br />Councilman Fletcher asked permission of the Council to leave the state for <br />two weeks. Councilman McNulty moved, seconded by Councilman Granger, that <br />'t <br />permission be granted. Motion passed unanimously. <br />Councilman Fletcher inquired about the examination which -was to be held in <br />connection with the position of Police Sergebnt.. City,Manager Mead <br />advised that this examination had -already been conducted and that the <br />man who received the highest score in the examination and also had -several <br />Years seniority had been appointed to the position. Councilman Fletcher <br />asked if any credit was given to the man who had been acting in this <br />position. It was his opinion and -also that of Councilman Britschgi that <br />some credit -should be given for years of service, Councilman Britschgi <br />5 being of the opinion that the matter should be referred to the Board of <br />Review for their recommendations. Councilman Granger believed the whole <br />civil service system should be studied by the Board of Review, his opinion <br />being that the whole system needed revision. Councilman Armstrong did <br />not believe the Board of Review had the -authority to act in this capacity <br />as it was merely a board to hear complaints of employees and recommend to <br />f <br />the Council new position classifications. The matter was placed on the <br />agenda for the next meeting. <br />OV Attorney McCarthy advised Councilman McNulty that he would cite the owner <br />of the Fat Boye Barbecue to show casue why they should not be prosecuted <br />
