230 �a:... <br />purposes, harbor development or the carrying out of any of the powers granted <br />to said Board, and to exclusively find and determine by ordinance adopted <br />by a four-fifths (4/5) vote of all its member the public interest and nec- <br />essity thereof. <br />(17) To appoint a Port Attorney whose duty it shall be to pass upon <br />the form and legality of all contracts within the jurisdiction of the Board, <br />give legal advice to the Board on official matters, defend and (subject to <br />directions from the Board) prosecute or compromise all actions at law or in <br />equity and special proceedings for or against the City of Redwood City or <br />any officer thereof in his official capacity, pertaining to matters within <br />the .jurisdiction of the Board. The Board shall fix and provide for his <br />compensat ion, <br />(18) to do and perform any and all other acts and things which may be <br />necessary and proper to carry out the general powers of the City, or any of <br />the provisions of Sections 47 to 50a of this Charter, and to exercise all <br />powers not in conflict with the Constitution of the State, or with this <br />charter, germane to the scope of its powers, purposes and duties. <br />(e) The proposition or proposal, to amend Section 49a of said Charter <br />of said City to read as follows: <br />Section 49a. CONTRACTS: Except where the expenditure involved by a <br />contraoi does not exceed the sum of Five Hundred Dollars ($500.00), and <br />except where the expenditure involved exceeds Five Hundred Dollars ($500.00) <br />but does not exceed the sum of Two Thousand Dollars ($2,000.00), provided <br />any contract within the latter range be approved by four-fifths (4/5) of <br />the whole Board of Port Commissioners, all contracts shall be made and en- <br />tered into upon competitive bidding in the manner and form as provided in <br />Section 67 of this Charter, and all powers and duties therein conferred or <br />imposed upon the City Council are, in relation to all matters connected <br />with the port, hereby conferred and imposed upon the Board, and all powers <br />and duties therein conferred or imposed upon the City Manager are, in re- <br />lation to all matters connected with the Port, hereby conferred and imposed <br />upon the Port Manager. Plans and specifications at the time of publication <br />of notice of inviting such bidding must be on file in the office of the <br />Board, subject to public inspection. <br />For said proposition or proposal (a) <br />being to amend Section 21 of the Charter of the :YES <br />City of Redwood City. : NO <br />For <br />said proposition <br />or <br />porposal (b) <br />being to <br />amend Section 32 <br />of <br />the Charter of <br />:YES <br />the City <br />of Redwood City. <br />:NO <br />For <br />said proposition <br />or <br />proposal (c) _ <br />being to <br />amend Section 17 <br />of <br />the Charter of <br />:YES <br />the City <br />of Redwood City, <br />:NO <br />For <br />said proposition <br />or <br />proposal (d) <br />being to <br />amend Section 47f <br />of <br />the Charter of <br />:YES <br />the•City <br />of Redwood City. <br />:NO ; <br />For said proposition or proposal (e) <br />being to amend Section 49a of. the Charter of :YES <br />the City of Redwood City. :NO <br />FURTHER RESOLVED that any voter who desires to vote in favor of amend- <br />ing either one or both of the sections of the charter of the City of Redwood <br />City mentioned herein, may do so by stamping a cross (X) in the voting <br />square on the right nand margin of his ballot and after and opposite the <br />word YES, and after and opposite the proposed amendment he favors, and <br />after such ballot shall be so stamped and deposited in the "ballot box it <br />shall be canvassed and counted as provided by law as a vote in favor of <br />such amendment and accepting the same. <br />Any voter who desires to vote against the amending of either one or <br />both of the sections of the charter of the City of Redwood City mentioned <br />herein, may do, so by stamping a cross (X) in the voting square on the right <br />hand margin of his ballot and after and opposite the word NO, and after and <br />opposite the proposed amendment he .rejects, and after such ballot shall be <br />SO stamped and deposited in the ballot box, it shall be canvassed and <br />counted as provided by law as a vote against such amendment and rejecting <br />the same. <br />The cross (X) shall be made only with a stamp, which, with the neces- <br />sary pads and ink will be provided for each booth for the purpose. <br />The above and foregoing resolution was passed and adopted by the Council <br />of the City of Redwood City at a regular meeting thereof held on the 18th <br />day of February, 1946, by the following vote: <br />AYES, and in favor of the passage and adoption of the foregoing <br />resolution: <br />Councilmen: ARMSTRONG, FLETCHER, GRANGER, MCNULTY, BRITSCHGI_,_AND,__ <br />HILTON. <br />It <br />IN <br />
