R E S 0 L U T ION No. 307 AUTHORIZING AN EASEMENT FOR SANITARY SEWER TRUNK LINE AS PART OF ' SEWAGE TREATMENT AND DISPOSAL PLANT. RESOLVED, by the City Council of the City of Redwood City that it finds and determines and hereby declares: That public interest and necessity require the acquisition, construction and completion by the City of Redwood City of a public improvement, namely, a sanitary sewer trunk line in those certain lands hereafter in this, resolu- tion described: That the use of all of said lands for said sanitary sewer trunk line is a public use authorized by law; That the taking of an easement in said lands is necessary to and for such public use, and that it is necessary that an easement in all of said lands be so taken; That said proposed sanitary sewer trunk line is planned and located in a manner which will be most compatibel with the greatest public good and the least private injury; FURTHER RESOLVED that the City Manager of this City be and he is hereby authorized and empowered: To acquire, in the name of this City, an easement in the hereinafter described lands by condemnation in accordance with the provisions of the Code of Civil Procedure of the State of California relating to eminent domain; to prepare and prosecute in the name of this City such suit or suits in the proper court having jurisdiction therein, as are necessary to condemn such easement in such lands for said use; To make application to said court for an order fixing the amount or the cmounts of such security in the way of money deposits as said court may direct to be made upon the taking of possession of said lands or any of them by this City; and for an order permitting this City to take immediate possession and use of an easement as hereinafter described in said lands; To make deposit of such security out of proper funds of this City in such amount or amounts'so fixed and determined and in such manner as said court, in which the condemnation proceedings hereby authorized are pending, may direct. The real property hereinabove referred to is situated in the City of Redwood City, County of San Mateo, State of California, and particularly described as follows; to-wit: An easement five (5) feet in width; immediately adjoining an easement presently held by this City along the Northeasterly side of such present easement from the Southeasterly line of Rogers Street to the Easterly line of Middlefield Road, the easement now held by this City being en (10) feet in width on the Northeasterly side and immediately adjoining the Rancho Plugas Tine;ras shown on a map of Rancho de Las Pulgas, here- tofore recorded in the office of the County Recorder of said County of San Mateo, State of California. FURTHER RESOLVED that the City Manager of this City be and he is here- by authorized either before or after filing a complaint in eminent domain to negotiate with the owners of said lands for the purchase or acquisition otherwise of such easement at the reasonable value thereof as determined by an appraisal approved by this City Council. The above and foregoing Resolution was passed and adopted by the City Council of the City of Redwood City at a regular meeting thereof held on the 15th day of April, 19462 by the following vote; ' AYES: Councilmen: ARMSTRONG, BRITSCHGI, FLETCHER, GRANGER, McNULTY and HILTON, NOES:- Councilmen: NONE ABSENT: Councilman: ANDERSON W.
