The motion was seconded by Councilman Fletcher <br />and on roll call wad imamiropUsly, adgpted wit# Councilman Anderson absent. <br />R E S 0 L U T ION No. 307 <br />AUTHORIZING AN EASEMENT FOR SANITARY SEWER TRUNK LINE AS PART OF <br />' SEWAGE TREATMENT AND DISPOSAL PLANT. <br />RESOLVED, by the City Council of the City of Redwood City that it finds <br />and determines and hereby declares: <br />That public interest and necessity require the acquisition, construction <br />and completion by the City of Redwood City of a public improvement, namely, <br />a sanitary sewer trunk line in those certain lands hereafter in this, resolu- <br />tion described: <br />That the use of all of said lands for said sanitary sewer trunk line is <br />a public use authorized by law; <br />That the taking of an easement in said lands is necessary to and for <br />such public use, and that it is necessary that an easement in all of said <br />lands be so taken; <br />That said proposed sanitary sewer trunk line is planned and located in <br />a manner which will be most compatibel with the greatest public good and the <br />least private injury; <br />FURTHER RESOLVED that the City Manager of this City be and he is hereby <br />authorized and empowered: <br />To acquire, in the name of this City, an easement in the hereinafter <br />described lands by condemnation in accordance with the provisions of the Code <br />of Civil Procedure of the State of California relating to eminent domain; to <br />prepare and prosecute in the name of this City such suit or suits in the <br />proper court having jurisdiction therein, as are necessary to condemn such <br />easement in such lands for said use; <br />To make application to said court for an order fixing the amount or <br />the cmounts of such security in the way of money deposits as said court may <br />direct to be made upon the taking of possession of said lands or any of them <br />by this City; and for an order permitting this City to take immediate <br />possession and use of an easement as hereinafter described in said lands; <br />To make deposit of such security out of proper funds of this City in <br />such amount or amounts'so fixed and determined and in such manner as said <br />court, in which the condemnation proceedings hereby authorized are pending, <br />may direct. <br />The real property hereinabove referred to is situated in the City of <br />Redwood City, County of San Mateo, State of California, and particularly <br />described as follows; to-wit: <br />An easement five (5) feet in width; immediately adjoining an <br />easement presently held by this City along the Northeasterly <br />side of such present easement from the Southeasterly line of <br />Rogers Street to the Easterly line of Middlefield Road, the <br />easement now held by this City being en (10) feet in width <br />on the Northeasterly side and immediately adjoining the Rancho <br />Plugas Tine;ras shown on a map of Rancho de Las Pulgas, here- <br />tofore recorded in the office of the County Recorder of said <br />County of San Mateo, State of California. <br />FURTHER RESOLVED that the City Manager of this City be and he is here- <br />by authorized either before or after filing a complaint in eminent domain <br />to negotiate with the owners of said lands for the purchase or acquisition <br />otherwise of such easement at the reasonable value thereof as determined <br />by an appraisal approved by this City Council. <br />The above and foregoing Resolution was passed and adopted by the City <br />Council of the City of Redwood City at a regular meeting thereof held on <br />the 15th day of April, 19462 by the following vote; <br />' AYES: Councilmen: ARMSTRONG, BRITSCHGI, FLETCHER, GRANGER, McNULTY <br />and HILTON, <br />NOES:- Councilmen: NONE <br />ABSENT: Councilman: ANDERSON <br />W.
