On roll call, <br />resolution was unanimously adopted with Councilman Armstrong absent. <br />R E 8 0 L U T ION No. 308 <br />DETERMINING TO MAKE IMPROVEMENT WITHOUT COMPLICANCE WITH INVESTIGATION <br />ACT. <br />RESOLVED, by the Council of the City of Redwood City, -California, that <br />WHEREAS, on March 18, 1946, this Council adopted its"Resolution of <br />Preliminary Determination No. 289 to construct certain public improvements <br />more particularly therein described, and did fix therein the date of April <br />1st, 1946 as the time when and the Council Chambers, City Hall, Redwood City, <br />as the place where, any and all persons interested may appear and show cause, <br />if any they have, why the City council should not find and determine that the <br />Public convenience and necessity require the improvements described and <br />referred to in said resolution, without oompliance.with the Special Assess- <br />ment Investigation, Limitation and Majority Protest Act of 1931; and <br />WHEREAS, notice of the adoption of said Resolution of Preliminary <br />Determination and of the time and place of hearing was given by the City <br />Clerk by publication and posting for the time and in the manner provided <br />in said resolution of preliminary determination and Ordinance No. 515 of said <br />City, as appears from affidavits on file with the City Clerk; and <br />WHEREAS, written objection to the undertaking of said proceedings <br />without first complying with the provisions of said Investigation Act have <br />been filed with the City Clerk at or before the time fixed for this hearing <br />by persons interested, owning or having an interest in real property within <br />the proposed assessment district, bearing their signatures, a description of <br />their property, and a statement of the nature of their interest therein; and <br />WHEREAS, all persons interested have been given an opportunity to be <br />and were fully heard, and said council has duly considered any and all <br />objections and protests made, and the said proposed improvements, and the <br />public convenience and necessity for making same, <br />NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED, as follows: <br />t <br />1. That the public convenience and necessity require the improvements <br />described in said Resolution of Preliminary Determination No. 289. <br />2. That any and all objections and protests made pursuant to said <br />resolution of preliminary determination be and the same are hereby overruled <br />and denied. <br />3. That the improvements described in said resolution be made under <br />and pursuant to the provisions of the Redwood City Ordinance No. 333 and that <br />the Special Assessment Investigation, Limitation and Majority Protest Act <br />of 1931 shall not apply to said proceedings. <br />I hereby certify the foregoing to be a true copy of resolution adopted <br />by the City Council of the City of Redwood City, California, at a regular <br />meeting thereof held on the 15th day of April, 1946, by the following vote <br />of the members thereof. <br />AYES: Councilmen: ARMSTRONG, BRITSCHGI, FLETCHER,GRANGER, McNULTY <br />and HILTON <br />NOES:' Councilmen: NONE <br />ABSENT: Councilman: ANDERSON <br />RALPH S.
