Councilman McNulty believed an effort should be.made to contact the present owner and attempt to place on option on the property before starting condemnation proceedings. City Manager Blom advised that he believed an option was already held on the property but that he would ascertain if this were true. Councilman Britschgi amended his motion to provide that if an option is alreday held on the property condem- nation proceedings be instituted and if there is no option at present that the city attempt to obtain one. The motion was seconded by Councilman Armstrong. There was more discussion on the matter and Councilman Britschgi withdrew his motion with the consent of the second and Councilman Armstrong moved adoption of resolution authorizing the City Attorney to start condemnation proceedings against the parking lot area in the event the owner of the prop- erty is unwilling to grant an option on the property to the city for the pur- chase of said property. The motion was seconded by Councilman Britschgi and on roll call was unanimously adopted. RES OL UT ION No. 333 AUTHORIZING CONDEMNATION OF LANDS IN FEE FOR OFF STREET PUBLIC PARKING LOT ON PERRY STREET RESOLVED, by the City Council of the City of Redwood City that it finds and determines and hereby declares: That public interest and necessity require the acquisition, construc- tion and completion by the City of Redwood City of a public improvement, namely, an off-street public parking lot in that certain property hereinafter in this resolution described; That the use of all of said land for said public parking lot is a public use authorized by law; That the taking of said property in fee is necessary to and for such public use, and that it is necessary that all of said property be so taken; That said public parking lot is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; FURTHER RESOLVED that the City Manager of this City be and he is hereby authorized and empowered: To acquire in fee, in the name of this City, the real property herein- after described, by condemnation, in accordance with the provisions of the Code of Civil Procedure of the State of California relating to eminent domain; To prepare and prosecute, in the name of this City such suit in the proper Court having jurisdiction therein as is necessary to condemn such lands in fee for such use; To make application to said Court for an order fixing the amount of such security in the way of money deposits as said Court may direct to be made upon the taking of possession of said property by this City, and for an order permitting this City to take immediate possession and use of said property; To make deposit of such security out of proper funds of said City in such amount so fixed and determined and in such manner as said Court in which the condemnation proceeding hereby authorized is pending may direct. n = The real property hereinabove referred to is situated in the City of Redwood City, County of San Mateo, State of California and particularly de-' scribed as follows: BEGINNING at a point on the southwesterly line of that certain parcel designated Lot "Al' on that certain map entitled "Perry's Subdivision of Lots 13, 14, & 15, Mezesville Villa Lots" filed August 5, 1924 in Volume 11 of Maps at pages 67 and 68, Official Records of San Mateo County, California; said point of beginning being distant South 43000' East 122.72 feet along said Southwesterly line from the most Westerly t ..e cor-Ar of said Lot "A"; and running thence North 37039' East 142.88 feet to point on the Southwesterly line of Perrytreet as that street is shown on the official map of Redwood City; thence along said Southwes- terly line, South 51013' East 171.24 feet and South 52021' East 3.79 fees;
