copy of the letter which City Clerk Dodge read. Councilman Armstrong <br />moved that the City Manager be instructed to follow through with this <br />matter and make a report in thirty days as to the progress. The mo- <br />tion was seconded by Councilman McNulty and passed unanimously. <br />Results of the sidewalk improvement work were announced with R. G. Clifford <br />being the low bidder on Unit 12 Resolution of Intention 1945-1; and <br />11. Weber being the low bidder on Units 2, 3, and 4. Resolutions of <br />Intention No. 1945-2, 3 and 4. City Attorney McCarthy advised that <br />he had examined the bidder's bond of Mr. Weber and that it met all <br />legal requirements and that Mr. Clifford's certified check of $3000 <br />was more than ample. Mr. Sorensen asked to see the two low bids. <br />He said that he had bid "across the board".on the four jobs and had <br />put in a bid bond to cover all four. City Attorney McCarthy advised <br />that the Council was at liberty to accept bids on each of .the jobs as <br />a separate project: Mx. Sorensen questioned the legality of Mr. Weber's <br />bond which Mr. McCarthy stated met all legal requirements. Mr. Sorenson <br />objected to the bid being awarded to Mr. Weber. <br />Councilman Armstrong moved, seconded by Councilman Anderson, that affidavits <br />of public notice of accepting bids be filed. Motion passed unanimously. <br />City Attorney McCarthy advised he had prepared resolutions awarding <br />the bids on each unit. Councilman Anderson asked if the presept bonds <br />would stand during the entire work to which City Attorney McCarthy re- <br />plied that they would stand only until the contractor executed,the.con- <br />tract to do the work at which time two new bonds would be required, <br />one for 50 per cent of the contract price for faithful performance of <br />the contract and the other for 50 per cent of the contract price of labor <br />and mateilials. <br />There followed another discussion in regard to the type of bond sub- <br />mitted by Mr. Weber and City Attorney McCarthy advised that before Mr. <br />Weber's bid was accepted it would be checked to see that affidavits are <br />correct as to the statement of worth. Mr. Sorensen again strenuously <br />obj ected to the type of bond. <br />Councilman Armstrong offered resolution and moved its adoption <br />ordering work done and awarding bid for work to be done under Resolution <br />of Intention 1945-1 to R. G. Clifford. The motion was seconded by <br />Councilman Britschgi. Resolution was unanimously adopted on roll call. <br />Councilman Fletcher offered resolution and moved its adoption or- <br />dering work done and awarding bid for work to be done under Resolution <br />of Intention No. 1945-2 to Mr. Weber.
