1 <br />LI <br />El <br />. <br />motion but with the understanding that the ordinance must be adhered to. <br />The motion passed with Councilman Fletcher voting in the negative for the <br />reason that he did not believe it was fair to the present used car dealers. <br />City Manager Mead presented a sketch showing the different types of pavement <br />surfaces for streets which was examined by the Council. Attorney Millington <br />appeared before the Council advising that City Attorney McCarthy had pre- <br />pared an agreement in regard to waiving the bond as requested and the type <br />of improvements to be installed vrhibhvas satisfactory to the developers of <br />Broadway No. j and, if it was agreeable to the Council, could be signed by <br />the next meeting of .the Council. City Attorney'McCarthy read the agreement. <br />Councilman Anderson asked if there was a provision for a release of the prop- <br />erty when payment is made. City Attorney McCarthy was of the opinion that <br />it was implied in the agreement but that he would have no objection to in- <br />cluding it. Councilman Anderson suggested that the agreement be amplified by <br />inserting a provision for the release of any "lot from the Tien for the public <br />improvements whenever the owner thereof shall have deposited with the City <br />Treasurer the amount estimated as the cost of improvements for which such <br />lot will be chargeable. City Manager Mead advised there was a correction <br />to be made in regard to the width of sidewalks, saying they should be 12 <br />feet in width and not 5 on Broadway. This correction was accepted by the <br />owners. Councilman Armstrong asked if the performance of any work was <br />being waived and was advised that it was not, that only the bond was being <br />waived. Councilman Anderson expressed the opinion that the city was fully <br />protected by the terms of the agreement and Councilman McNulty moved, sec- <br />onded by Councilman Fletcher, that the City Manager be instructed to exe- <br />cute the contract after the property owners have all signed with the sug- <br />gestion of Councilman Anderson incorporated in the agreement and the width <br />of the sidewalks on Broadway changed from 5 feet to 12 feet. Councilman <br />Armstrong asked if the agreement were to be recorded and was advised that it <br />was. Councilman Granger asked that it be shorn in the minutes that the docu- <br />ment is to be recorded. Motion passed unanimously. <br />Attorney Millington asked if it would be possible to have the map (a,-WdIV "`3) <br />passed so that it wouldn't be necessary for his clients to again appear <br />before the Council, exp],aining that if the City Attorney coq d advise the <br />City Clerk that all legal requirements have been met the City Clerk could <br />be authorized to certify the map. Councilman Anderson moved, seconded by <br />Councilman Britschgi, that the City Clerk be authorized to certify the map <br />upon advice from the City Attorney that all property owners have signed the <br />agreement. Motion passed unanimously. <br />City Manager Mead reported on the violation of the used car ordinance. He re- <br />ported that he had sent a letter to each of the used car dealers notifying <br />them of the violations and requesting their cooperation. He presented a <br />
