M. a` <br />�w <br />City Clerk Dodge called the meeting to order and announced that nominations were open <br />for mayor pro -tem. Councilman Granger moved, seconded by Councilman Werder, that <br />Councilman Armstrong 'be appointed mayor pro -tem. Motion passed unanimously, a <br />Mayor Armstrong called the meeting to order and on roll call the following were pres- <br />ent: Councilmen Britschgi, Granger, McNulty, Swift, Werder, Mayor pro -tem <br />Armstrong and City Clerk Dodge. Also present were: City Manager E. W. Blom, <br />City Attorney Paul A. McCarthy, Building Inspector L. M. Duncan, Acting Police 'z <br />i <br />3 <br />Chief J. L. Lodi, City Engineer Don S. Wilson, and Street Superintendent H. L. <br />Winter. Absent: Mayor W. W. Hilton. <br />Mayor Armstrong announced that members of the Seventh Grade, McKinley School were <br />present in connection with their study of local government and welcomed <br />them to the meeting. <br />Communication was received from Archie Klang and Eleanor Klang requesting permission <br />to hook into city sewer system from Lots 7 and 8, Horgan Tract. City Engineer <br />Wilson advised that the property abuts on the Woodside Road and that it would <br />be physically possible for this sewer to connect into the city system. There <br />was considerable discussion as to whether this area would be favorable to <br />annexing to the city, it being the general consensus of the council that they <br />did not wish to permit any sewer from outside the city limits to hook into the <br />city system. Mr. Klang was present and stated that some of the area wished to <br />come into the city. After more discussion, it was suggested that Mr. Klang <br />attempt to interest the people in this area to petition for annexation to the <br />city. <br />Attorney Wayne Millington appeared before the Council requesting them to reconsider <br />their refusal to rescind the sale of Lot 7, Block 10, Lenolt to Joseph DeGeller. <br />The interested parties are all agreeable to having the sale rescinded. Mr. <br />Millington stated there was a quiet title suit on file which would not be heard <br />for several months. It was explained that this lot had been advertised for sale <br />following the usual procedure and that the highest bid had been received from <br />Mr. DeGeller. City Attorney McCarthy explained that Mr. H. H. Weiner got a <br />deed from the former record owners, a Mr Grider and Mr. Treadwell, in the name <br />of Grider and paid the delinquencies at the County. After being informed of <br />this, the Council had authorized the City Attorney to start <br />a suit to quiet <br />title to obtain complete title to the lot. Mr. Millington then <br />filed a suit <br />on behalf of Mr. Grider to acquire quiet title. It was the <br />opinion of the <br />City Attorney that the city had about a 50-50 chance to win <br />the suit. <br />It was the opinion of Mayor Armstrong that the city could not <br />lose by going <br />ahead with the suit inasmuch as taxes and penalties would be <br />paid if the suit <br />!� <br />were lost and, if won, the city would receive the sale price <br />of the lot. It <br />was the contention of Attorney Millington that the city was <br />not in the real <br />estate business and that inasmuch as all taxes and penalties <br />would be paid the <br />request should be granted. City Attorney McCarthy stated he <br />believed a com- <br />promise would be appropriate. <br />
