■; <br />2 7 v the conditions of the Notice to Bidders is one of fact, to be determined by <br />the Council after a careful consideration of the bide submitted, If the <br />Council should find that any of the firms submitting bids have not complied sub- <br />stantially with the conditions of the Notice to Bidders, then the bid of such <br />firm, or firms, can, and should, be rejected and disregarded on the grounds of <br />noncompliance.' On the other hand, if the omissions or deficiencies are of a <br />minor nature and there has been a substantial compliance with the conditions <br />prescribed, then the bid may be considered. <br />In determining who' is the "lowest responsible bidder". the Council is not <br />confined to the amount of the bid. In arriving.at your determination of this <br />fact, you can properly conside the product of the bidder as well as his credit <br />and his ability to do the job. The Courts generally have upheld the actions <br />of a public body if they are acting in good faith and are not seeking to <br />evade some provision of the law applicable." <br />COMMUNICATION WAS RECEIVED from Egbert Clark, Rector of St. Peters Episcopal Church asking <br />permission to hang sign over either El Camino Real or Broadway advertising "County <br />Fair" to be held by them on September 19th and 20th. ,After discussion, Councilman <br />Werder moved denial of request, seconded by Councilman Holmquist due to the fact <br />that Council did not favor nor allow the practice only when advertising public <br />celebrations such as Fourth of July etc. Motion carried. <br />COMMUNICATION RECEIVED FROM THE OPTOMIST CLUB registering their objection to locating <br />Armory building in the Recreation area and recommending that the City endeavor to <br />find a more suitable location was ordered referred to the Armory Committee on motion <br />of Councilman Granger, seconded by Councilman McNulty, and carried. <br />COMMUNICATION FROM FRANK STRYKER, 616 Charter Street, protesting recently enacted taxi <br />fares and inadequate bus service. Councilman Holmquist moved, seconded by Councilman <br />Swift, that the matter be referred to City Manager for further investigation. <br />COMMUNICATION RECEIVED FROM REDWOOD CITY KIWANIS CLUB requesting that steps be taken as <br />soon as possible to correct the local creek problem was ordered filed. <br />REQUEST OF WALDO STONE to again consider his request to resubdivide his property in <br />Wellesley Park was ordered referred back to the Planning Commission for further <br />consideration. <br />MRS. OLIVIA NARDELLI, 1140 Sutter Street, San Francisco, requested Council to reconsider <br />request for permit to operate restaurant to be known as "Scenic Inn" at the location <br />formerly known as °Two Friends Cafe°. After further discussion Councilman Britschgi <br />moved denial of request, seconded by Councilman Werder and carried unanimously. <br />COUNCIL14AN McNULTY OFFERED RESOLUTION, seconded by Councilman Werder, carrying out recom- <br />mendation of Auditor C. G. Uhlenberg relative to writing off delinquent water accounts <br />receivable and closing out Serviceman's Emergency Fund into General Fund, with the <br />understanding that efforts to collect delinquent water accounts be continued. <br />Resolution adopted unanimously on roll call. <br />RE S0LUTI ON No. 507-A <br />RESOLUTION AUTHORIZING ACCOUNTING CORRECTIONS AS RECOMMENDED BY C. G. UHLENBERGIS <br />AUDIT DATED AUGUST '7, 1947. <br />RESOLVED, and it is hereby ordered that the Auditor make the transfers as rec- <br />ommended by the Audit Report' of C. G. Uhlenberg, dated August 7, 1947. <br />Paragraph 4, Page 9, which reads as follows: <br />"For the purpose of this report we have divided consumers accounts receivable <br />between "currentil and "delinquent". Included in the delinquent accounts receivable <br />are numerous old consumers' accounts aggregating $3,355.4.7, dating back to the year <br />1942 and prior, which should have been written off as uncollectible in prior years. <br />In view of the fact that most of these accounts are "outlawed" and in many cases <br />the debtor can not be located, it is our recommendation that the Oity Council for- <br />mally authorize the "write-off" of these accounts. This action should not in any <br />way be construed to preclude the collection of the accounts at some future <br />date as is evidenced by the fact that the sum of $139.60 has been collected on <br />$961.42 uncollectible accounts written off during the current year." <br />And paragraph 3, Page 15, which reads as follows: <br />0 <br />G� <br />It, <br />u <br />
