7 <br />Attorney McCarthy questioned the number of members on the committee and, after <br />discussion, it was decided to change the wording to provide that the chief of <br />police and city engineer shall act on the commission in an advisory capacity. <br />Councilman Armstrong stated he had studied the ordinance and believed that it <br />was a worthy one. He moved, seconded by Councilman Werder, introduction of <br />' ordinance setting up a Traffic Safety Commission. Motion passed unanimously. <br />Building Inspector Duncan reported that the Viarenze property was greatly improved. <br />The yard has been cleaned and a permit taken out to construct the room for <br />the sanitary facilities. Councilman Armstrong moved, seconded by Councilman <br />McNulty, that the matter be carried on the agenda for the first meeting iA <br />November. Motion passed unanimously. <br />City Attorney McCarthy presented ordinance providing for change in setback lines <br />on James Avenue and California Street. Councilman Granger offered introduc- <br />tion of the ordinance. Councilman Armstrong raised the question as to what <br />arrangements had been made in regard to the lot along the oreek owned by Mrs. <br />Reid and which would be practically confiscated by the change in setback lines <br />City Attorney McCarthy stated his opinion was that the ordinance was to be <br />adopted establishing the setback and than an assessment district was to formed <br />to acquire the lot from Mrs. Reid. After more discussion, it was felt that <br />it was not fair to Mrs. Reid to establish the setback before compensating her <br />for the lot, and it was agreed that an agreement should be worked out before <br />changing the setback lines so that Mrs. Reid's interest could be protected. <br />Councilman Granger's motion was lost for lack of a second. <br />City Manager Blom advised that Mr. Ernest Wilson had called on him in the after- <br />noon and did not believe that he would be present at the meeting. The matter <br />of consideration of proposed ordinance amending improvement procedure ordi- <br />nance was ordered carried on the agenda. <br />City Clerk Dodge read petition signed by property owners on Bonita Avenue request- <br />ing paving of street. City Manager Blom advised that the petition had been <br />studied by the City Engineer and that only 35fo of the total frontage on <br />Bonita Avenue was involved. He did not believe that it indicated a suffici- <br />ent majority to go ahead with the project unless a further canvass of the <br />street is made. Councilman Armstrong moved, seconded by Councilman Britsehgi, <br />that the petition be referred to the sender with the above information. <br />Motion passed unanimously. <br />Claims No. 211-271 in the amount of $25,806.85 were approved and ordered paid on <br />motion of Councilman McNulty, seconded by Councilman Armstrong. Motion <br />passed unanimously. <br />Councilman Werder offered resolution authorizing condemnation suit on Lots 6 to 14, <br />Block 605, Highlands of Emerald Lake for the purpose of acquiring a reservoir <br />site.
