and''determines and hereby declares: <br />That public interest and necessity require the acquisition, construc- <br />tion, completion and maintenance by said City of Redwood City of a public <br />improvement, namely: a reservoir site for the municipal water system of <br />this City in that certain property hereinafter in this resolution described; <br />That the use of all of said land for the purpose hereinabove stated is <br />a public us authorized by law; <br />That the taking of said property in fee is necessary to and for such. <br />public use, and that it is necessary that all of said property be so taken; <br />That said reservoir site is planned and located in a manner which will <br />be most compatible with the greatest public good and the least private injury; <br />FURTHER RESOLVED that the City Manager of this City be and he is hereby <br />authorized and empowered: <br />To acquire in fee, in the name of this City, the real property herein- <br />after deoribed, by condemnation, in accordance with the provisions of the <br />Code of Civil Procedure of the State of California relating to eminent <br />domain; <br />To. prepare and prosecute, in the name of this City, such suit in the <br />proper dourt having jurisdiction therein as is necessary'to condemn such <br />lands in fee for such use; <br />To make application to said Court for an order fixing the amaunt of such <br />security -in the way of money deposits as said Court may direct to be made <br />upon the taking of possession of said property by this City, and for an order <br />permitting this City to take immediate possession and use of said property; <br />To make deposit of such security out of proper .funds of said City in <br />such amount so fixed and determined and in such manner as said Court in which <br />the condemnation proceeding hereby authorized is pending may direct.. <br />The real property herein referred to is situated in the County of San <br />Mateo, State of California and is particularly described as follows: <br />Lots 6,, 7, 8, 9, 10, 110 12 and 13 in Block 605, as designated <br />on the map entitled "Highlands of Emerald Lake Subdivision Six", <br />which map was filed in the office of the Recorder of San Mateo County <br />State of California on May 4, 1927, in Book 15 of Maps at pages <br />64, 65 and 66. <br />The above and foregoing Resolution was duly passed'and adopted by the <br />Council of the City of Redwood City at a regular meeting thereof held on the <br />23rd day of September, 1946, by the following vote: <br />AYES, and in favor of the passage and adoption of the foregoing <br />Resolution: Councilmen: ARMSTRONG, BRITSCHGI, GRANGER, McNULTY, SWIFT, <br />WERDER and Mayor HILTON. <br />NOES, Councilmen: NONE <br />ABSENT, Councilmen: NONE <br />ATTEST: <br />RALPH S. HILTON <br />Mayor of the City of Redwood City <br />City Attorney McCarthy advised that the condemnation suit to acquire recreational <br />area had been set for four separate trials. The city will have to put up <br />$100 for jury fees and he asked that the Treasurer be authorized to set <br />aside $100. <br />Mr.•14cOarthy also asked if the Council would desire to have additional <br />counsel in regard to the condemnation suit of the Baird property.
