J <br />counsel were available. It was the consensus of the Council that inasmuch <br />as this suit was to be strongly contested it would be advisable to have <br />the additional counsel. Councilman Armstrong moved, seconded by Councilman <br />Granger, that the City Attorney be authorized to engage additional counsel <br />in the Baird condemnation suit. Motion passed unanimously. <br />Councilman Granger questioned material being purchased from the Easterday Supply <br />Company and not locally. City Manager Blom advised this had been a large <br />I <br />order and that bids had been submitted both locally and out of town. <br />Easterday Supply Company was the low bidder. <br />Councilman Werder moved, seconded by Councilman McNulty, that the meeting be <br />adjourned. Motion passed unanimously. <br />� A4414_- <br />R.S. DODGE / City Clerk <br />MINUTES OF SPECIAL,MEETING <br />REDWOOD CITY COUNCIL <br />September 30, 1946. <br />8:00 P. M. <br />On roll call the following were present: Councilmen: C. A. Britschgi, F. D. <br />Granger, G. W. McNulty, A. V. Swift, W. M. Werder, Mayor W. W. Hilton and <br />City Clerk R. S. Dodge. Also present were: City Manager E. W. Blom, City <br />Attorney P. A. McCarthy, Assistant Bldg. Inspector S. E.. Kreiss, Police <br />Chief C L. Collins. Absent : Councilman C. C. Armstrong. <br />City Clerk read letter from Mr. C. A. DeGeller requesting the Council to cancel <br />the sale of Lot 7, Block 10, Lenolt Tract, stating that he had made a <br />satisfactory settlement with -R. V. Grider and Robert C. Treadwell. On <br />motion of Councilman McNulty, seconded by Councilman Swift, letter was re- <br />ferred to City Attorney McCarthy directing him.to contact parties interested <br />and complete the transaction which would net the city the full amount of the <br />sale price of the lot. <br />City Manager E. W. Blom next reported to the Council the status of bids on laying <br />water mains. He explained Harvey Conner had submitted low bid, however due <br />to work on hand he was unable to promise date of completion acceptable to <br />the City. In view of this, City Manager Blom recommended that bid of next <br />lowest bidder, Underground Construction Co. be accepted on Jobs 1 to 4, in- <br />clusive. Regarding Job No. 5, there was a possibility the City would not <br />have to construct the line inasmuch as M. G. King, subdivider, was negotia- <br />ting with another supplier. In case Mr. King decided to tie in with another <br />system, City Manager will secure a release of liability covered by deed to, <br />the property in question which would make it mandatory for the City to sup- <br />ply water. In case Job #5 became,a necessity, City Manager Blom requested <br />authority to enter into contract with Mcquire and Hester, second low bidder <br />on this job. <br />Mayor Hilton questioned the legal aspect of Mr. Conner's bid being rejected, <br />and City Attorney McCarthy read an opinion which he had written for Mr. Blom <br />to the effect that inasmuch as he had failed to reach a. satis factory agree- <br />ment in regard to time of completion of contract, and inasmuch as Mr. Conner <br />had requested that he be released from his bid, there is nothing to stop the <br />
