10 <br />City te'th'ering into a valid contract with the next lowest bidder. Councilman a <br />Weider moved, seconded by Councilman Britschgi, that the recommendation of the <br />City Manager be accepted. Under the question, Councilman Granger stated his opin- <br />ion that the City should secure a release from Mr. Conners to safeguard their <br />interest. City Attorney McCarthy advised the City was amply protected inasmuch <br />as Mr. Conners had requested in writing, release from his bid. Suggestions that <br />Job #5 be held up was discussed and City Manager stated he would like the Council•, <br />to authorize him to handle this matter when Mr. King made his decision. This <br />was agreed upon and motion was passed unanimously. <br />Matter of Hudson Park final map was next on the agenda. City Clerk read two letters <br />from Planning Commission, one recommending approval of final map subject to <br />submission of a plan by the subdiver, David Holder, which would be acceptable <br />to the Council assuring that no unsightly condition result on Lots 7, 81, 9 and <br />10 as observed from the Redwood Avenue Side. The second letter recommended set <br />back lines on Lots 5, 6, 7 and 8 to be 15 feet and on Lots 3, 42 9 and 10 to <br />be 20 feet. <br />A letter was, read from C. E. Randlett, Civil Engineer, outlining a plan of Mr. Holder <br />to plant a hedge along Redwood Avenue porperty line and make a deed restriction <br />for these lots that hedge be maintained. <br />Mr. James T. O'Keefe, Jr. appeared for the property owners objecting to the accept- <br />ance of final map. Mr. O'Keefe stated he had had considerable experience in <br />such matters and it was his contention that the map as submitted did not repre- <br />sent sound planning. He stated further that nowhere to his knowledge was the <br />facing of•baok yards to a public street permitted. <br />1 <br />Mr. Randlett stated Mr. Holder would be willing to dedicate the strip of land <br />between the creek and Redwood Avenue to the City for a park, contending that <br />the planting of shrubs, trees, etc. would eliminate the objectionable feature. <br />Councilman Werder stated that inasmuch as both parties were'of the opinion <br />that plan as submitted was undesirable, he believed Mr. Holder and his engineer <br />should get together and replan the subdivision so that the objectionable fea- <br />tures be eliminated. Councilman Werder moved that the matter be referred back <br />to the subdivider and his engineer to refigure and that the final map as sub- <br />mitted be disapproved. After further discussion, motion carried unanimously. <br />City Manager Blom explained to the Council that due to oversight, Redwood Terrace <br />No. 1 had not been posted nor had the legal notice advertising hearing and = <br />opening of bids on October 7th been published, therefore it would be necessary <br />to postpone action and further procedure before hearing could be held. City <br />Attorney suggested that a resolution should be passed changing thime of hear- <br />ing and calling for bids. Councilman Britschgi offered such a resolution, <br />seconded by Councilman McNulty, and same passed unanimously on rbll call. <br />Councilman Armstrong noted absent. <br />RESOLUTION No. 400 <br />NOTE "Resolution 400 was superceded by Resolution No. 401 passed and <br />adopted October 7, 1946. <br />
