98 <br />were anxious to assist him to make repairs to the building and asked that no action <br />be taken against him. City Attorney McCarthy administered the oath to Building <br />Inspector Duncan and the following testimony was recorded: <br />City Attorney McCarthy: Would you kindly state to the Council the cause for the <br />citation to show cause why the place shouldn't be inhabited. <br />Mr. Duncan: Why, the first complaint was an outside privy - that has been taken <br />down, holes filled and all taken are of. Mr. Sablan at the present time lives <br />in a little place in the back of the home his daughter and son-in-law live in. <br />City Attorney McCarthy: What is the condition of the place in which Mr. Sablan <br />sleeps? <br />Mr. Duncan: Does not conform to the building law in any respect. They have <br />agreed to tear that building doom. <br />City Attorney McCarthy: How many buildings on the lot? <br />Mr. Duncan: The home and then this little one in the back - they are going to <br />tear the little one down. The one in front is a nice cottage. <br />City Attorney McCarthy: It'would satisfy the requirements of the Building <br />Department if the building that Mr. Savlan is occupying is torn down? <br />Mr. Duncan: Yes. They will tear that one down and build a room on to the home. <br />City Attorney McCarthy: The matter might be adjourned to see if the requirements <br />of the Building Inspector are complied with. <br />Mayor Hilton asked if the house could be habitable. Building Inspector Duncan <br />replied that it could not be. <br />Councilman Britschgi moved, seconded by Councilman McNulty, that the matter be <br />placed on the agenda for the second meeting in March. Motion passed unanimously. <br />City Attorney McCarthy presented a prepared report on the legality of the Council's <br />delegation of power to the United Veterans' Council in administering the Veterans' <br />Building. The consensus of the report was that the United Veterans' Council may <br />be permitted by the Council to manage the hall, situated on public property, and <br />may confine its use to solely veterans' associations although he believed the <br />United Veterans' Council could legally permit the American Veterans' Committee <br />to use the building and he also believed the Council could direct the United <br />Veterans' Council to permit the use of the hall by the American Veterans' Committee <br />since the building is occupying public property. Mr. Louis Dematteis, a member <br />of the United Veterans' Council; expressed his appreciation for the consideration <br />given this matter by the Council and assured the Council that the United Vet- <br />erans' Council would continue to manage the building in keeping with the original <br />understanding. <br />City Attorney McCarthy asked that the report on delinquent bonds'be carried on the <br />agenda. It was so ordered. <br />City Manager Blom advised that some repairs had not as yet been completed at 768 <br />Woodside Road in regard to the request for a restaurant license. He recommended <br />that the matter be dropped from the agenda until such time as the repairs are <br />completed. It was so ordered. <br />Resolution providing for partial distribution of surplus in regard to Redwood Terrace <br />No. 1 was presented.
