194.8-2, and moved its adoption, seconded by Councilman Holmquist and carried on 191 <br />roll call. <br />RESOLUTION No. 705 <br />RESOLUTION OF PUBLIC CONVENIENCE AND NECESSITY - KENSINGTON SQUARE No. 1, 1948-2. <br />WIEREAS, on the 18th day of April, 1949, the City Council of the City of Redvrood <br />i� City adopted a Resolution of Preliminary Determination to make public improvements <br />in that area in the City of Redwood City commonly known and referred to as Kensington <br />Square,'being Resolution No. 697 of said Council, to construct certain public im- <br />provements more particularly described therein, and did fix therein this date as the <br />time and place when and where any and all persons interested may appear and show <br />cause, if any they have, why the City Council should not find and determine that the <br />public convenience and necessity require the improvements.described and referred to <br />in said resolution without compliance with the Special Assessment, Investigation, <br />Limitation and Majority Protest Act of 1931; and <br />WHEREAS notice of the adoption of said resolution and of said time and place of <br />hearing was given by the City Clerk by publication and posting for the time and in <br />the manner provided in said resolution and Ordinance No. 515 of the City of Redwood <br />City, as appears from the affidavits on file with the City Clerk; and <br />WHEREAS no persons objecting to the undertaking of said proceedings without <br />first complying with the provisions of said Special Assessment, Investigation, Limi- <br />tation, and Majority Protest Act of 1931 have filed written objections thereto with <br />the City Clerk at or before the time fixed for this hearing by persons interested, <br />owning or having an interest in real property within the proposed assessment district, <br />bearing their signatures, a description of their property, and a statement of the <br />nature of their interest therein; and <br />WHEREAS all persons have been given an opportunity to be and were fully heard., <br />and said Council has duly considered any and all objections and protests made, and <br />the said proposed improvements and the public convenience and necessity for making <br />the same; <br />NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Red- <br />wood City, as follows: <br />1. That public convenience and necessity require the improvements described in <br />said Resolution No. 697. . <br />2. That any and all objections and protests made pursuant to said resolution be, <br />and the same are, hereby overruled and denied. <br />3. That the improvements described in said resolution be made under and pur- <br />suant to the provisions of Article I of the Redwood City Improvement Procedure <br />Ordinance (Ordinance No. 333, adopted March 14, 1932, as amended), and that the <br />Special Assessment, Investigation, Limitation and Majority Protest Act of 1931 shall <br />not apply to said proceedings. <br />Passed and adopted by the Council of the City of Redwood City at a regular <br />meeting thereof held on the 2nd day of May, 1949, by the following vote: <br />AYES, and in favor of the passage and adoption of the foregoing resolution: <br />Councilmen: BRITSCHGI, GRANGER, HOLMQUIST, MORGAN, SPILLERS, SWIFT, and Mayor WERDER. <br />NOES, Councilmen: NONE <br />ABSENT, Councilmen: NONE <br />ATTEST: <br />'A <br />RALPH S.
