He had prepared a resolution declaring that trees <br />constituted a nuisance and it was incumbent upon the Council to decide on how many days, ten days to <br />jwo weeks, to abate the nuisance. Councilman Holmquist offered resolution and moved adoption as pre- <br />pared by the City Attorney giving the owner ten days in which to remove trees, seconded by Councilman <br />Spillers. Motion carried on roll call. Councilman Granger noted absent. <br />RESOLUTION N0. 755 <br />DECLARING TREES ON LOTS 19 AND 20, LEXINGTON PARK, TO BE A PUBLIC NUISANCE AND ORDERING <br />THEIR ABATEMENT <br />WHEREAS certain trees located on Lots 19 and 20, Lexington Park, on Harrison Avenue near Myttle <br />Street in the City of Redwood City, constitute a danger to the lealth, safety and convenience of the <br />residents of the City of Redwood City; and <br />WHEREAS Julius Berendsen, owner of the lotVon which said trees are located, has permitted the <br />roots of said trees to grow into the sanitary sewer mains and laterals located in Harrison Street; and <br />WHEREAS, for more than one year last past the City of Redwood City has been compelled to expend <br />great sums'of money in clearing and cleating the roots of said trees from said sanitary sewer system; <br />and <br />WHEREAS said roots have caused a stoppage of said sanitary sewer system to such an extent that raw <br />sewage has overflowed in adjacent properties served by said sanitary sewer system, thereby creating a <br />grave health hazard to the residents in that area, and threaten to continue to create said stoppages; <br />and <br />WHEREAS limbs from said trees overhanging Harrison Avenue threaten to falrinto the streets and <br />on the sidewaiks in said area, thereby greatly endangering pedestrian and -automobile traffic on said <br />Harrison Avenue; <br />NOW, THEREFORE, BE IT AND IT HEREBY IS RESOLVED by the Council of the City of Redwood City, as <br />follows: <br />1. That said trees and roots are hereby declared to be a public nuisance; <br />2. That Julius Berendsen,the owner of the lots on which said trees are located, shall have ten <br />(10) days from the date of receipt of a certified copy of this resolution in which to abate said nui- <br />sance by removing said trees and roots; that if said nuisance is not abated by said owner within said <br />ten-day period, the City Attorney is hereby authorized and directed to bring an action for damages and <br />for the abatement of said nuisance against said owner. <br />Passed and adopted by the Council of the Ci* of Redwood City at a regular meeting thereof, held <br />on the 15th day of August, 1949, by the following vote: <br />AYES, and in favor of the passage and adoption of the foregoing resolutions Councilmen:.
