WERDER <br />Mayor of the City of Redwood City <br />RESOLUTION 639. City Attorney Currie stated this resolution authorized the City to <br />79 <br />enter into an agreement with Nelson M. Welbanks which would cancel agreement entered <br />into February 3rd in which the City agreed to install water main. Councilman Morgan <br />offered and moved adoption of resolution authorizing contract to pay cost of water <br />system - Emerald Lake Heights. Motion carried on roll call. <br />RESOLUTION <br />No. 639 <br />AUTHORIZING CONTRACT <br />TO <br />PAY <br />COST <br />OF <br />WATER SYSTEM - EMERALD LAKE HEIGHTS <br />WHEREAS, NELSON M. WELBANKS and the CITY OF REDWOOD CITY entered into an agree- <br />ment dated February 3, 1947 whereby NELSON M. WELBANKS agreed to install a water sys- <br />tem in the subdivision known as Emerald Lake Heights and to convey title to said <br />water system to the CITY OF REDWOOD CITY, and the CITY OF REDWOOD CITY agreed to <br />construct a certain water main connecting said water systen to the CITY OF REDWOOD <br />CITY'S water system; and <br />WHEREAS, the CITY OF REDWOOD CITY and NELSON M. WELBANKS entered into an agree- <br />I ment subsequent to the agreement dated February 3, 1947, whereby NELSON M. WELBANKS <br />was to install the water main originally to be installed by the CITY OF REDWOOD CITY <br />and in return the CITY OF REDWOOD CITY was to pay the cost of such installation to <br />NELSON M. WELBANKS; and <br />WHEREAS, some controversy has arisen over the rights of the CITY OF REDWOOD <br />CITY and NELSON M. WELBANKS under that subsequent agreement, and the CITY OF REDWOOD <br />CITY is desirous of settling and determining finally the rights and liabilities of <br />the parties under that subsequent agreement; <br />NOW THEREFORE, BE IT RESOLVED that the CITY MANAGER of the CITY OF REDWOOD CITY <br />be, and he hereby is authorized and directed to enter into a contract with NELSON M. <br />WELBA14KS according to the terms and conditions of a contract which is attached <br />hereto and made a part of this resolution. <br />Passed and adopted by the Council of the City of Redwood City at a regular <br />meeting thereof held on the 6th day of December, 1945, by the following vote: <br />AYES, and in favor of the passage and adoption of the foregoing resolution: <br />Councilmen: BRITSCHGI, GRANGER, HOLMQUIST, MORGAN, SPILLERS, SWIFT, and Mayor , <br />WERDER. <br />17 <br />NOES, Councilmen: NONE. <br />ABSENT, Councilmen: NONE. <br />ATTEST: <br />RALPH S.
