Council- <br />man Granger moved that the map be accepted subject to City Engineer Jain's recommen- <br />dation that the tax certificates be presented from both City and County and Prelimin- <br />ary Title report from the Title Company, seconded by Councilman Jones and carried. <br />ItiESTWOOD TERRACE No. 1 APPROVAL OF FINAL MAP. City Attorney Currie was preparing agreement for improvements and separate <br />agreemetn for water - Improvement Bond for 119,000 including water mains, tract <br />boundaries and $10,000 bond and agreement for water mains to tract. Councilman Jones <br />' moved approval of map subject to above conditions, seconded by Councilman Morgan. <br />When the bonds would be submitted, County and City Auditors certificates and two <br />agreements signed, Tract Map could be recorded. A 60' strip was <br />deeded to the City lying between Westwood Terrace No. 1 and Redwood Terrace No. 1 <br />to be improved as a street according to requirements of City without any cost to City. <br />)ITY ATTORNEY'S REPORT ON TAX DEEDED LOTS IN ASSESSMENT DISTRICTS. There were several <br />lots in Kensington Square District and some of the other assessment districts. City <br />Attorney Currie thought the City should not pay the assessments on any of these lots <br />since the City would not have the bond and the owner of the lot could pay delinquent. <br />taxes and would not have to repay the assessment. Councilman Morgan moved this be <br />referred to the Real Estate Committee for a full report to the Council, seconded by <br />Councilman Jones and carried. City Attorney suggested that title be quieted to all <br />tax delinquent lots, and the lots sold in order to get them back on the tax roll. <br />TATER SUPERINTENDENT REPORT ON SURVEY OF HOMES UNDER CONSTRUCTION IN EMERALD LAKE. <br />Councilman Morgan moved this be carried on agenda until report could be had from <br />the Real Estate Committee on their recommendation, seconded by Councilman Jones and <br />carried. <br />TOPOSED AGREEMENT M.J.KING INC. WATER MAINS WOODSIDE TERRACE N0, 2. On June 11, 1950 <br />M. J. King Company representatives, Frost & Brian, Engineers, City Manager Rblison, <br />Prater Superintendent H. L. Winter and City Engineer Jain had a discussion regarding <br />water mains which were constructed in this tract at grades shallower than called for <br />in the plans and specifications. At that time certain commitments were made and <br />later put in the form of an agreement and submitted by Mr. Jain to the Council along <br />With his report. A letter from IA. J. King confirmed this agreement including a five <br />Year guarantee to maintain all mains and services not meeting City specifications. <br />City Engineer recommended that agreement be accepted provided that both E. T. Haas <br />Company and M. J. King Company execute such an agreement with the City covering this <br />five year maintenance guarantee. To date there was no confirmation from E. T. Haas <br />Company. M. J. King Company was awaiting a settlement of this problem so that they <br />could proceed with .further street construction in this area. The mains were laid <br />behind the curbs. If they were requested to remove and lower them it would cost <br />03,000 or $4,000.
