Councilman Royer moved that the public hearing be closed, seconded by <br />Councilman Britschgi. Mrs. Rankine stated that the same objections could be added. <br />Motion carried. <br />Councilman Britschgi moved that.the recommendation of -the Planning Commission to deny <br />ij <br />be upheld, seconded by Councilman Stout and carried on roll call, Councilman Spillers <br />noted absent. Councilman Granger moved that the petitions which were presented Tonight <br />be made a part of the record, seconded by Councilman Jones and carried. In answer to <br />question of Mr. Eskin, City Attorney Currie stated that there is nothing to stop repeated <br />rezoning applications under the present. ordinance. The Council could restrict reappli- <br />cation to six months or any reasonable period they so chose. <br />APPLICATION FOR "CLOSE OUT SALE" PERMIT, THERESA'S KIDDIE SHOP, 1744 EL CAMINO REAL. The' <br />Clerk reported that all was in order according to the ordinance. Mr. Dell'Ergo, <br />Attorney, stated that the request was. being applied for because Mrs. Theresa Giavia <br />was in no condition to continue her business because of a recent automobile accident <br />wherein her back was.broken. Councilman Jones moved that the permit be granted subject <br />to the usual requirements, seconded by Councilman Royer and carried. <br />APPLICATION FOR "CLOSE OUT SALE" PERMIT, VELARDE PHARMACY, 1740 E1 Camino Real. The Clerk <br />reported that all was in order according to ordinance. Councilman Britschgi moved that <br />the permit be granted subject to the usual.requirements, seconded by Councilman Royer <br />and carried. <br />PUBLIC HEARING, PROPOSED ANNEXATION BREWSTER AVENUE RESERVOIR TERRITORY. Affidavit of <br />publication ordered filed. Mayor Herkner announced opening of public hearing. ,There <br />being no protests, written or oral, Counci.lman.Britschgi moved that the public hearing <br />be closed, seconded by Councilman Stout and carried. Councilman Jones offered intro- <br />duction of ordinance., seconded by Councilman Granger and carried.on roll call, Councilman <br />Spillers noted absent. <br />REPORT AND ASSESSMENT, 1955-56 WEED ABATEMENT. City Attorney Currie reported that the weed <br />abatement assessment list -had been p.osted.on.the. bulletin .board.. Mayor opened public <br />hearing. There being no protests, written or oral, Councilman Britschgi moved that <br />the public hearing be closed, seconded by Councilman Jones and carried. Councilman <br />Royer offered RESOLUTION NO. 1919 CONFIRMING WEED ABATEMENT REPORT and moved its <br />adoption, seconded by Councilman Britschgi and carried on roll call, Councilman Spillers <br />i <br />' noted absent. <br />ADOPTION OF'AMENDMENT TO ORDINANCE 600 REDUCING PLANNING COMMISSION HEARINGS FROM TWO TO ONE. <br />Affidavit of publication was ordered filed. Mayor Herkner opened public hearing. The <br />Clerk read a letter of protest from the Peninsula Civic League, Inc. in which they <br />stated that relief could be provided for the Planning Commission in more constructive <br />ways than the adoption of this amendment to Ordinance No. 600 and urged its defeat. <br />_ I <br />Councilman Jones stated that this has been discussed by the Planning Commission and the <br />Council and both were in agreement. There was only one protest. Councilman Jones <br />moved that the public hearing be closed. Mayor Herkner explained that this merely <br />reduced the Planning Commission hearings by one. Additional hearings still had to come <br />up before the Council.
