<br />Minutes of the Regular Adjourned Meeting
<br />Redwood City Council
<br />May 211 1956, 8:00 P. M.
<br />Invocation was lead by Reverend Ronald H. White, Pastor First Methodist Church,
<br />ON ROLL CALL the following were noted present: Councilmen Floyd D. Granger, Sidney D. Herkner, Robert V. Spillers,
<br />Hiram S. Stout, Louis Weiss, Mayor William H. Royer and City Clerk pro -tam John J. Bropby. Councilman
<br />' Carl A. Britschgi was noted absent. Also present were City Manager E. A. Rolison, City Attorney C. Be
<br />Currie, City Engineer Glenn M. Jain, Fire Chief J. L. Lodi, Water Superintendent H. L. Winter, Assistant
<br />. Water Superintendent Warren Mitchell, Assistant to City Manager L. A. Kimball, Building Inspector S. H.
<br />Kreiss, Acting Police Chief Theodore Moudakas, Account -Clerk Vivan Holmquist, Vincent Rambo of the Stulsaft
<br />Park Committee and Carl Sjoberg of the Planning Commission.
<br />The minutes of May 7th and May 114th were approved as mailed on motion of Councilman Spillers, seconded by
<br />Councilman Herkner, Councilman Weiss calked attention to the action on a concession stand in Hawes Park and
<br />as reported on page 8 of the minutes of May 114th. That motion was passed without his being aware of the
<br />import of the conversation that was going on. The point, however, is that the action was out of order and
<br />for all purposes and intents is illegal. The minutes of May 7th, pages 5 and 7, indicates -that the question
<br />of a concession was considered - in that case the City Attorney ruled that it would require bids, that
<br />insurance must be provided. Further the same minutes indicate that the -Council passed a motion to refer
<br />the matter to the City Manager for a complete report and recommendation. In view of the facts and circum-
<br />stances involved and with apologies for his inadvertance in not calling attention to this at that time,
<br />Councilman Weiss moved that the purported action which contravenes the ruling made by the City Attorney,
<br />and which appears to be illegals be expunged from the minutes. It will thur be possible to take proper
<br />action on the proposal for a concession in the manner and procedures followed previously as per minutes of
<br />� May 7th. The City Attorney ruled -that they could not strike out the motion as suggested by Councilman
<br />Weiss, but, it the Council desired, they could make another motion which would in effect nullify the
<br />motion as approved on May 114th. The motion approving the minutes as mailed carried, Councilman Weiss's
<br />remarks to be -acted on later in meeting.
<br />PUBLIC HEARING, PLANNING COMMISSION DENIAL APPLICATION N. T. MARCELLI RO REZONE PORTION LOT 114, BLOCK E,
<br />WOODSIDE ACRES•(1696 KENTFIELD) FROM R-2 TO R-3. The Clerk read the Planning Commission's letter wherein
<br />they stated that they felt that the zoning was premature for two reasons (1) that it will'tend to discourgge
<br />the development of a street to the rear (Sierra Street and (2) the Planning Commission would prefer to wait
<br />for a few month to�study the recommendations of the Land use Plan now underway. Mr. Marcelli reported
<br />that a portion of his land is already in R-3 and he wanted to rezone all of his land so they could build
<br />more apartments. He further stated that he would be willing to give the City 271, feet for the future
<br />widdning of Sierra Street. This was followed by discussion in regard to future development of Sierra
<br />Street ane what effect, it an, it would have on the property in question. Councilman Spillers moved that
<br />Ithe public hearing be closed, seconded by Councilman Herkner and carried. Councilman Granger moved, based
<br />on the evidence and due to the fact that these people could again apply for rezoning that the Planning
<br />P Commission's recommendatio to deny be up held, seconded by Councilman Weiss. This was followed by discuss-
<br />ion after which the motion carried with Councilman Spillers voting No.
<br />PLANNING COMMISSION DENIAL APPLICATION

<br />a=' I ACRES (1690 Kentfield) FROM R442 TO R-3. There were no written protests. The Planning Commission recom-
<br />mended denial on this property for -the same reasons they recommended denial of Mr. Marcelli's Property.
<br />These two parcels adjoin one another. Mr. Jamison, representing Mr. Twyman, spoke on the subject, which
<br />was followed by discussion. Councilman Spillers moved that the public hearing be closed, seconded by
