SCHWARTZ FOR VARIANCE TO ALLON 51 REAR YARD INSTEAD OF <br />15, ON LOT 7, BLOCK 1, POPLAR SUBDIVISION (333 RED71OCD AVENUE). The Planning Commission was not able to <br />find the following facts referred under Ordinance 600: <br />1. <br />That <br />there is <br />unnecessary hardship <br />2. <br />That <br />the land <br />or property is different in character from adjoining land <br />3. <br />That <br />it would <br />not be detrimental to the area. <br />Chief Lodi also recommended against this application -because of residential occupany and no alley to the <br />rear for access. <br />Councilman Herkner moved approval of the Planning Commission's recommendation to deny the application, <br />seconded by Councilman Stout and carried. <br />0. C. JONES REQUEST EXTENSION OF TIME ON PARKING LOT CONTRACT. 'City Engineer Jain was of the opinion that this <br />should be held over until the job is completed. Councilman Britschgi moved to hold this up for two weeks, <br />seconded by Councilman Granger and carried. <br />C. G. UHLENBERG REPORT ON INTEREM EXAMINATION OF ACCOUNTS. The Clerkread the report. Councilman Weiss moved <br />that the report be filed, seconded by Councilman Britschgi and carried. ' <br />COUNTY MANAGER REGARDING SUPERVISORS RESOLUTION FORMING GARBAGE AND REFUSE DISPOSAL DISTRICT. The County sent <br />a copy of their Resolution 10550 ordering -formation of garbage and refuse disposal district to be known <br />as the South County'Garbage and Refuse Disposal District, and defining and establishing the boundaries of said <br />district. City Attorney Currie said this was a matter of information only. The Mayor asked that this <br />be turned over to the City Engineer. Councilman Herkner attended a meeting and the next meeting will be <br />held next Monday and the 5th director will be elected. <br />CLAIM FOR ALLEGED INJURY TO MRS. REES DUE TO FALL ON 300 BLOCK OF CHESTNUT BETWEEN PENNSYLVANIA AND HELLER. <br />Councilman Stout moved that the claim be denied and referred to the insurance carrier, seconded by Council- <br />man Britschgi and carried. <br />CLADS FOR ALLEGED INJURY TO MRS. DE MOSS DUE TO FALL IN FRONT OF 720 ELM STREET. Councilman Herkner moved <br />-that the claim be denied and referred to the insurance carrier, seconded by Councilman Britschgi and <br />carried. <br />•BIRGE CLARK LETTER OF APPREICATION UPON RECEIPT OF RESOLUTION OF 0010MENDATION. The Clerk read the letter after <br />which Councilman Stout moved that the letter be filed, seconded by Councilman Weiss and carried. <br />HIGHLAND IMPROVEMENT CLUB LETTER OF APPRECIATION FOR COUNCIL ACTION REGARDING HIGHLANDS TERRITORY NO. 1 <br />' IMPROVEMENTS. The Clerkread the letter, and the letter was ordered filed. <br />USE PERMITS GRANTED BY THE PLANNING COMMISSION: <br />1. Application of Dr'. McCauley for a doctor's office at 1269 Jefferson Avenue. <br />2. H. Wattenburg for an apartment at 29 Edgewood Road in a P-1 District. The Clerk read a letter <br />submitted by Martin E. Field wherein he stated that he would regard the granting of Mr. Wattenberg's <br />' application an implied acceptance by Council of a similar application by himself. The Mayor stated that the <br />Council could not act on this letter and asked that it be filed. No Council action was necessary on these <br />items. City Attorney Currie asked that a letter be written to Mr. Field telling him that the Council could <br />i <br />not act on his letter and all applications are dicided on own merits.
