NM <br />Councilman Spillers moved that the City Clerk or the City Attorney contact the applicant and ask <br />� <br />. <br />them to consider changing the title of their used car lot, seconded by Councilman Weiss and carried. <br />I <br />Councilman Stout moved that they reactivate the proceedings of the previous action with Russ Denny in <br />regard to the condition of the sidewalks, seconded by Councilman Weiss. Councilman Spillers stated <br />I <br />that two yeers.ago this sidewalk matter w as brought to the attention of the Council and the Council <br />took the stand at that time that the sidewalk would be fixed when the street work was done. City <br />• <br />Engineer Jain stated that he has sent out several sidewalk notices to Mr. Denny but nothing has been <br />lil <br />L{' <br />done. He stated that situation was not as stated by Councilman Spillers. Mayor Royer asked that the <br />City Engineer check into this matter and report back to the Council. Councilman Stout's motion was <br />restated by the Mayor that the Cita/ Engineer reactivate the project and refer his findings back to the <br />j <br />Council in one week, seconded by Councilman Weiss and carried. <br />PLANNING COMMISSION RECOMMEND APPROVAL APPLICATION TO MOVE BUILDING FROM 1520 BAYSHORE, EAST PALO ALTO, TO <br />SOUTHERLY CCRNER OF JEFFERSON AVENUE AND THE BAYSHORE HIGHWAY. The building in question is Justins <br />Drive -In Restaurant which is of steel and stucco construction. Councilman Stout moved approval of the <br />Planning Commission's recommendation, seconded by Councilman Spillers. Councilman Granger stated that <br />he was not in favor of moving in any tin shacks into the City. This was followed by Discussion. <br />i <br />Councilman Britschgi stated that he was familiar with the building and he stated that it is approximately <br />3 years old and in very good condition. City Engineer Jain stated that this should be subject to <br />conditions. The Clerkread a section from the Planning Commission minutes wherein they approved this <br />subject to: <br />1. Compliance with Building Department's requirements. <br />2. Owner to complete all necessary curb, gutter and sidewalk improvements on Jefferson <br />Avenue and Bayshore Highway. <br />3. To complete all necessary State Highway Department's requirements for improvements <br />on Bayshore Highway, <br />4. Owner to construct sewer, water and other utility facilities. <br />5. The ultimate improvement and realigning of Redwood Creek Channel. <br />Councilman Herkner offered a substitute motion that this be delayed one week, pictures of the building <br />to be brought in, seconded by Councilman Granger. The substitute motion lost on roll call vote with <br />Councilmen Britschgi, Spillers, Stout and Mayor Royer voting NO. The original motion carried on roll <br />call with Councilman Granger voting NO. <br />PLANNING COMMISSION RECOMMEND APPROVAL RESUBDIVISION LOP 8-C, BLOCK 19, OAK KNOLL MANOR (E. Riff, 585 Upland <br />Road) SUBJECT TO PUTTING IN SEWER MAIN AND LATERAL AND DEEDING A 7 FOOT WIDENING STRIP ALONG BRYPTSTER. <br />DENY VARIANCE FROM THE 20 FOOT FRONT AND REAR SETBACK TO A 15 FOOT FRONT AND REAR SETBACK., same <br />property. Councilman Herkner moved approval of the resubdivision subject to obtaining the deed. <br />City Attorney Currie stated that the usual procedure was to wait for the deed. Councilman Herkner <br />withdrew his motion and made another one to hold this over until such time as the deed is obtained, <br />seconded by Councilman Spillers and carried. <br />Councilman Stout moved to approve the Planning Commission's recommendation to deny the variance, <br />seconded by, Councilman Britschgi and carried. <br />PLANNING C0199SSION RECOMMEND APPROVAL 0. PORKONY APPLICATION TO REZONE LOT 17, WELLESLEY PARK SUBDIVISION <br />(49 CLAREMONT) FROM R-1 TO R-3 SUBJECT TO ALL RESTRICTIONS. There were no protests at the public <br />hearing. held by the Planning Commission. Therefore, the Commission recommended the rezoning of this <br />lot because it is the last R-1 lot in the immediate neighborhood. Councilman Spillers moved that this <br />be set for public hearing on July 16th3 seconded by Councilman Stout and carried. <br />TRAFFIC FACT FINDLING COMMITTEE IZECOM!vMDATION REGARDING HIRING OF TRAFFIC ENGINEER. The Clerk read the <br />f ollowing report submitted by the City Manager for the Traffic Fact Finding Committee: <br />
