The Clerk read the following report:
We have reviewed the history of the sidewalk problem at the northwest corner of blain
Street adjacent to property owned by the Russ Denney Auto Sales and Service.
The following is an excerpt from City Council minutes of April 11, 1955: "Mr. Russ
Denney appeared before the Council appealing for final inspection which will clear utilities
in his new showroom on the corner of Main and Elm Streets which is now completed. He in-
formed -the Council that the City Engineer notified hila that sidewalk must.be completed to
Lathrop Street, according to the ordinance covering sidewalks. tie wishes to pour sidewalk
only on that protion of Main and Elm fronting.the new building. Engineer Jain informed the
Council that when nor. Denny's original building was completed the sidewalks were in a
hazardous condition and Mr. Denny received a notice to repair the sidewalk. At some
future date, if required, he will continue the sidewalk to Lathrop Street. Mr. Denney will
take steps to eliminate the hazardous condition of the old sidewalk on Elm Street. Motion
carried."
It was our understanding at this Council meeting that Idr. Denney was to install new
full width sidewalks between.the curb and property line on both Main Street and Elm Street
adjacent to the showroom building then under construction at this corner, and that the rest
of the sidewalk on Elm Street extending to Lathrop Street would be completed at such time as
further development or improvement of this mtreet was made, or whenever the condition of the
sidewalks indicated a hazard to pedestrians. The above Council minutes indicate that Mr.
Denney was to take steps to eliminate the then hazardous condition of the sidewalk on Elm
Street.
The full width sidewalk required ,on Main Street and Elm Street adjacent to the show-
I
