305
CITY ATTORNEY REPORT REGARDING PARK AND RECREATION COMMISSION RECOMMENDATION TO ABANDON AND BLOCK OFF SMALL
TRIANAGULAR PARK IN THE VICINITY OF ANAMOR, KENTUCKY, ETC. City Attorney Costello stated that he
reported before as to the procedure to block off this park. He stated that he talked with Mr. Gold and
the Park and Recreation,Commission request that the park be abandons. The Commission 'feel that the matter
of the.sidewalks is up to the Council.
Mrs. Albert Thomas, 1705 Connecticut, presented a letter from the residents in the area which the Clerk
if read. Their letter was a request that the sidewalk alleyway and "park" between Connecticut Drive, Anamor
and Massachusetts Streets be closed and discontinued inasmuch as it has become a fire hazard, a health
hazard and a public nuisance. There were.15 signatures on the letter. Councilman Stout raised the
question of.whether or not the property owners whold, absorb this property as a part of their property and
thus do away with the sidewalks. Mrs. Thomas stated that all the property owners have verbally agreed
i
to move their fences. The.Mayor appointed Councilmen Spillers, chairman and Stout to work as a
Committee to meet with the peeple and report back to the Council*
CITY ENGINEER REPORT ON SIDEffALK CONDITIONS IN THE.VICINITY OF QUARTZ AND ST. FRANCIS STREETS. It was noted
.in the report that approximately 120 lineal feet of the frontage across which there are no existing
sidewalks is across Hatch Hetchy right -of tray property. There has been some question as to whether the
City could enforce the sidewalk ordinance against property owned by a public utility such as the San
Francisco Water Department. If this could be required, it is the City Engineer's r ecommendation that his
office.be instructed to send legal notices to construct and repair sidwalks in all those protions
indicated as needing such work. Councilman Granger suggested that they notify all the property owners,
including the Water Department, and let them tell the City why they will not do the work* Councilman
Britschgi stated that he believed that the Water Compar{y has agreement with the City that the City has to
I
maintain the sidewalks, street work, etc. This was followed by discussion. ('
k Councilman Stout moved that the City Engineer proceed along the usual channels to have the sidewalks
installed, seconded by Councilman Spillers. City Attorney Costello advised the Council that the crossing of
the Hetch•Hetchy right -of --way was governed by a revocable permit and the City must put in all improvements
and hold the Hetch Hetohy harmless. The only way that the Council could get the sidewalks repaired was to j
start condemnation proceedings. He felt that there was no need for this and for contacting the Hatch Hetchy
i
Company and suggested that the City do the work. City Engineer Jain stated that he would check with the
City Attorney before taking any action on the Hatch iietchy right-of-way. The motion carried.
Councilman Spillers requested the matter of bridges be placed on the agenda for next week.
i
The Mayor asked that the meeting be recessed until 10 o'clock. The meeting was recessed at 9:35 P. M.
The Mayor called the meeting to order at 10:35 P. M. -and announced that the agenda had been completed.
The City Attorney stated that he had an emergency ordinance ready for introduction* This ordinance should be
r considered an emergency and would establish regulations for connection -to the sanitary sewer system and
prohibiting occupancy of buildings producing damage or overload to the sahitary sewer system of the City
of Redwood City. Councilman Granger moved that the City Attorney furnish a copy of this ordinance to each
of the Council so they can make a reply next week, seconded by Councilman Spillers. Councilman Weiss stated
t
that this was an emergency ordinance and, as such, this should be intorduced tonight and the Council can
make their decision nest week. Councilman Weiss moved a substitute motion to introduce the ordinance.
The Mayor asked the City Attorneyif this substitute motion was in order. The City Attorney ruled it was
out of order. Councilman Weiss then moved that the matter be tabled. This motion lost for lack of a
second and was followed by discussion. Mr. Oddstad has agreed that there will not be any occupancy until
the Council has agreed to the adoption of this ordinance. City Enginneer Jain stated that the situation
was critical, the present sewage should be -removed before winter. Councilman Herkner stated that he
I
wanted it understood that no one can get a hook up under the present situation. The Mayor announced that
