344 <br />M <br />and carried. Councilman Stout moved that all other bids be rejected, seconded by Councilman Spillers <br />and carried. <br />PUBLIC HEARING - A. RUKAN application for rezoning lots 12 to 14, Block 15, Lenolt from,R-1 to R -!t. Mr. <br />J. P. Jensen, 331 B Street appeared to protest rezoning, representing the property owners in the <br />immediate area. Mr. Jensen presented a petition bearing 32 signatures, all opposing the rezoning. <br />Communication was also received from Mr. H. He Weiner in oppostion. Mr. A. Rukan appeared for the <br />owner and for the General Petroleum Corp. who are desirous of establishing a service station on the <br />location. Mr. Rukan referred to previous application which -came to the council last July and was <br />denied pending receipt of Land Use Plan which is being prpared. He stated that the property was <br />unsuited for residential use, and due to its proximity with the recently completed Industrial Way, <br />and the commercial activities on the opposite side of Whipple Avenue, was suited for commercial use. <br />Mr. Rukan had been advised that the land use plan contemplates the future use of lots 12 & 13 as R-4 <br />and for 14 & 15 as C -1-H. Mr. Tom Tuite spoke at length against further spread of commercial zoning. <br />Hearing was closed on motion of Councilman Spillers, seconded by Councilman Granger and carried. <br />Councilman Spillers stated his opinion that because of traffic on Whipple Avenue and Industrial 'Nay <br />and the fact that future traffic from Bayshcre Highway would be diverted to Whipple Avenue that the <br />property in question was not fit for residential purposes. Councilman Spillers motion to approve <br />Planning Commission recommendation died for lack of a second. <br />Councilman Stout then moved denial of Planning Commission recommendation, seconded by Councilman <br />Britschgi who stated that in his opinion the rezoning of these lots would establish a bad precgdent. <br />s <br />Councilman Weiss called attention to the land Use Plan Which had not as yet been presented to either <br />the Planning Commission nor the Council for final decision. He stated his feeling that action at <br />this time would be premature. Councilman Herkner disqualified himself inasmuch as property under <br />consideration was to be used for service station construction. Councilman Granger thought the time <br />had not yet arrived f or action, and would suggest holding up action until Freeway was completed and <br />established. Motion to dieny carried on roll call, Councilman Spillers voting NO. <br />REPORT - BAY AREA RAPID TRANSIT MEETING. Councilman Weiss prepared a very complete report covering the <br />November 19th meeting held by the Senate Interim Committee which was attended by himself and City <br />Manager. After discussion, Councilman Stout moved acceptance of report, copy to be furnished council- <br />men for study, seconded by Councilman Spillers. City Attorney Costello presented copy of resolution <br />from the City of Vallegjo and also a proposed resolution which will be considered by the County <br />supervisors at their Tuesday meeting. Clerk was instructed to forward copies of Council committee <br />report and also copies of Vallejo and County resolutions for further study. Motion carried. <br />RESOLUTION NO. 2146 AUTHORIZING TREASURER'S SIGNATURE BY FACSIMILE, INDUSTRIAL WAY IMPROVEMENTS was <br />offered by Councilman Spillers who moved adoption, seconded by Councilman Britschgi. In answer to <br />query from Councilman Granger, City Treasurer indicated he was in accord. Carried on roll call. <br />INTRODUCTION OF ORDINANCE AUTHORIZING ISSUANCE OF BONDS, POLICE BUILDING. Councilman Spillers moved <br />introduction of ordinance, seconded by Councilman Herkner and carried. <br />INTRODUCTION OF ORDINANCE AUTHORIZING APPROPRIATION OF FUNDS TO COVER BALANCE OF FUNDS NEEDED TO CONSTRUCT <br />POLICE BUILDING. City Attorney stated bids for bonds would not be opened until the December 17th <br />meeting at which time resolution awarding contract to low bidder for the construction of building <br />could be adopted. Councilman Granger questioned that, inasmuch as three weeks must elapse before <br />decision will be reached regarding the sale of bonds, it might not be appropriate to readvertise <br />for bids in an effort to receive a better bid. He called attention to the fact that originally it <br />was thought the building could be built for $150.,000 whereas low bid was in excess of S204,000. <br />
