Councilman Stout I was of the opinion that they should have some legal action and he -believed that they should go along with the proceedings. The Mayor stated that the City's legal position has not changed. The City Attorney stated that this statement was correct. The motion lost on roll call with Councilmen Granger, Stout and Weiss voting NO. Councilman Granger. stated that he wanted to change his vote. It was. finally decided that this could not be done so Councilman Granger moved and asked for reconsideration �3 of the vote, seconded by Councilman Herknere This was followed by discussion. Councilmen Granger and Ic Weiss stated that they wanted to vote again, their first vote being a vote to register a protest. The motion carried with Councilman Stout voting No and Councilman Spillers being noted absent. The City Attorney suggested that the Council pass a resolution authorizing him to drop the hearing suit. Councilman Herkner offered RESOLUTION 2175 AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO DISMISS LEGAL ACTION AGAINST THE CITY OF MENLO PARK and moved its adoption, seconded by Councilman Weymouth and carried on roll call, Councilman Spillers being noted absent. DISCUSSION ITEM 2, CITY MANAGER'S REPCRT OF DECEMBER 19, 19562 COUNCIL POLICY ON BRIDGE CONSTRUCTION AND FINANCING. Councilman Weiss spoke about the last paragraph of the City Manager's report dated 11/14/46. He was of the opinion that a priority list should -be established. Councilman Weiss moved that this matter be carried on the agenda for a study session to set a policy as to the disposition of the bridges, seconded by Councilman Herkner. The City Manager.stated that he would go along with this if he had the money available• This was followed by discussion. City Engineer Jain stated that there are approximately four bridges which are going to have to be built or repaired within the next two years. He feels that the Council should set up a policy. The motion lost on roll call with Councilmen Granger Stout and Mayor Royer voting No and Councilman Spillers being noted absent. Councilman Granger moved that the City Manager's recommendation to take up the matters separately be approved, seconded by Councilman Stout. Councilman Stout was of the opinion that money shou:ydibe raised by.taxation and they should give consideration to this matter. The motion lost on roll call with Councilmen Herkner, Weiss and Weymouth voting NO and Councilman Spillers being noted absent. DISCUSSION PROPOSLD MEETING WITH BELMONT AND SAN CARLOS TO EXPLORE COMMON PROBLEMS. Councilman Granger moved to drop the matter from the agenda, seconded by Councilman Stout. The Mayor stated that this matter was first brought up by the then Councilman Britschgi. Councilman Weiss spoke on the question after which the motion carried with Councilman Weiss voting No. DISCUSSION ANNEXATION FEES. COUNCILMAN Stout asked that this be carried on the agenda for two weeks. .The Mayor so ordered. DISCUSSION PROPOSED MICRCFILMING. Councilman Weiss moved that this matter be referred to the City Manager and City Clerk for a report prior to budget time, seconded by Councilman Granger. Councilman Granger i j stated that a previous report has been turned in and at that time it cost too much money and that the a 3. I matter had then been dropped. Councilman Stout spoke on the subject and concurred with the statement i of Councilman Granger. The motion carried. DISCUSSION PROPOSED TAPE RECORDING, COUNCIL MEETINGS. Councilman Granger moved that this be referred to the time when they discuss the minutes, seconded by Councilman Herkner and carried. The Mayor called attention to the study meetings. The Council would meet on Thursday, January 21tth, to discuss empoyees salaries and sales tax and if time allows the hospital sewage problem. On Wednesday, January 30th the Council will meet with the G]esmvood Avenue property owners regarding water lines. I On February 6th the Council will meet with the Civilian Defense representatives. John Quinn asked the Council who was responsible for safety measures at Cordillera Creek. Mr. Quinn was 1 referring to an article in the newspaper where a boy almost drowned. This was followed by discussion as to what responsibility, if any, the City had in this matter. It was finally decided that the j
