1 421 of Winslow Street to the rear of the new building on the north side of Winslow. , As of this date, we are unable to secure a permit from the City Engineer for this installation of a private service across a city street. It is Mr. Jain's contention that the P. G. & E. should either do this work or have a permit issured in their name thereby assuming responsibility. The P. G. & E., flatly refuses to do the work or take out a permit for same. Consequently we are at an impasse and respectfully request you consideration and decision. . The City Engineer stated that the City has not issured any permits to private companies to make use of City streets for private use. This should be either City owned or utility owned so it can be maintained and controlled properly. Mr. Jain suggested that the Council take.the stand and advise the Utility Ccmpanies if this is to be served it will be necessary for them to take out a permit to install the underground circuit. The City Attorney was asked to check into this matter. Councilman Spillers moved that the request be denied and the public utilities be notified that it will be underground and ask that they put in the installation, seconded by Councilman Stout. This was followed by discussion in regard to whether or not the public utilities can be foreced to install this underground circuit. Councilman Stout wanted to know if this was going to be setting a policy. The City Attorney stated that the City has an ordinance that anything put in the street can on]y be done so by permission from the Council. The motion carried on roll call with Councilman Granger voting NO. Councilman Stout suggested that the City manager bring in a survey as to what streets should 'have underground circuits. Councilman Stout moved that the Planning Commission revaluate the streets and list the streets s that they want to have underground circuits, seconded by Councilman Spillers and carried. TRAFFIC COr,WITTEE RECOMMENDATION REGARDING REALIGNMENT VALOTA ROAD AT WOODSIDE ROAD. The Committee recommends that there be no re -aligning of Valota Road as the widening of Woodside Road at a future date and the construction of a service road on the north side of Woodside Road will be sufficient to accomodate the flow of traffic at this location. Councilman Stout moved approval of the recommendation of the Traffic Committee, seconded by Councilman Spillers and carried. PLANNING COMI1ISSION RECOMMENDED APPROVAL C. BOVIMAN REQUEST TO REZONE PORTION LOT 113 BLOCK G, WOODSIDE ACRES (1631 UNION) FROM R-2 TO R -3-G IF, AND WHEN, THE COUNCIL APPROVES THE LAND USE PLAN. Councilman Spillers moved to set this matter for public hearing in two weeks, seconded by Councilman Stout. The City Attorney stated that the recommendation is to rezone from R-3 to R -3-G and he suggested that this matter be held until the Council considers R -3-G zoning. He recommended that this matter be continued until such time as the amendment is placed on the agenda. Councilman Spillers changed his motion to continue this matter until such time as the amendment is placed on the agenda for R -3-G zoning. The motion carried. PLANNING COMMISSION REQUEST APPROVAL TO ALLOY"I TWO OR THREE MEMBERS CF THE PLANNING TO ATTEND ONE OR TWO DAYS OF THE AMERICAN SOCIETY. OF PLANNING OFFICIALS ANNUAL MEETING in San Francisco March 17th to 30th. Councilman Spillers moved approval to allow the Planning Commission to attend the conference and they be reimbursed for their expenses, seconded by Councilman Granger and carried. COMMUNICATION ATTORNEY LEBSACK REGARDING LEGAL SERVICES FOR ASSESSMENT PROCEEDINGS KENTFIELD-PALM-VALOTA ROAD IMPROVEMENTS. The Clerkread the letter wherein Mr. Lebsack stated that they offer and agree to represent the City in the conduct of such proceedings and to furnish the following serviees therein: 1. Review engineering estimates, engineering design and the proposed assessment for the complete financing of said project. 2. Prepare all necessary ordinances, resolutions, contractor's agreembnts, notices and documents for the conduct of said proceedings as required by law. 3. Confer with you and other City officials with regard to the conduct of said proceedings.. 4. Prepare all necessary documents releting to the delivery of the bonds, including, but not limited to a non -litigation certificate and any transcript of the proceedings called for by the purchaser of said bonds. .
