Councilman Herkner offered RESOLUTION 2243 FINDING AND THAT PROTEST TO THE PROPOSED ,ANNEXATION TO THE,CITY OF REDWOOD CITY OF CERTAIN UNINHABITED TERRITORY DESIGNATED FARM HILL ADDT.TION ,NO. 1 HAS NOT BEEN MADE BY OWNERS OF ONE-HALF OF THE VALUE OF SUCH TERRITORY AS SHOUN BY THE LAST EQUALIZED ASSESSMENT ROLL, NOR,BY PUBLIC AND PRIVATE OWNERS EQUAL TO ONE-HALF OF THE VALUE OF SUCH iLL TERRITORY AS DETERMINED BY SAID.CGUNGIL and moved its adoption, seconded by Councilman Oranger and carried on roll call, Councilman Weiss voting No and Councilman Spillers being noted absent. Councilman herkner offered RESOLUTION 2244 AUTHORIZING AGREEMENT BETWEEN CITY OF REDWOOD CITY AND ODDSTAD HOMES IN CONNECTION WITH ANNEXATION OF CERTAIN TERRITORY TO CITY OF REDWOOD.CITY DESIGNATED FARM HILL ADDITION NO. 1 and moved its adoption, seconded by Councilman Weymouth, Councilman Weiss read a prepared statement which reads in part as follows: "Postponement of payment of the annexation fee would be a bad preceddnt and can many times in the future cause this Council considerable embarrass- ment .... We must not overlook or forget that this type of indebtedness .... cannot be made a lien against the property and I do not believe that payment at a later date could be enforced even in the event of default .... The Council cannot or should not enter into any agreement or take.any action that could result in the loss of specific revenues to the City .... the result of such action would be that for all purposes and intents we would be loaning the City's money to private corporations or individuals for their personal benefit and gain. I certainly believe that such action would be highly irregular, if not illegal, and certainly I cannot be a party to any such agreement." The City Attorney stated that this was not illegal., Councilman Weiss asked if this indebtedness could be enforced as a lien against the property. The City Attorney stated it was not a lien against the property. Councilman Weiss asked what their rights were to enforce the indebtedness at a later date. The City Attorney stated that as he had previously informed the Council there is some question about the enforcability of the agreement but stated that as a practical matter the Council had practical control of the situation since it governs the filing of subdivisionnmaps in the.area. Councilman Stout spoke on the subject and stated that since other cities had an annexation fee ordinance that he believed that the City could also have one. He .was of the opinion that this could be establishinga precedent. This was followed by discussion. The Mayor stated that the Council did not agree to waive the annexation fee. This was followed by discussion. The annexation fee will be paid before the map is recorded. Councilman Weymouth offered introduction of an ordinance of the City of Redwood City approving the annexation to the City of Redwood City of certain uninhabited territory designated "Farm Hill Addition No. 1" and herein described, and herein annexing said territory to said City of Redwood City, seconded by Councilman Stout and carried, Councilman Weiss voting NO. CITY MANAGER REPORT AND RECOI&ENDATION ON ST. VINCENT DE PAUL REQUEST FOR EXEMPT LICENSE TO OPERATE THRIFT SHOP. The Clerk read the letter from the City Manager in which he stated that he ohecked with the City Collector and has been informed that similar organizations are now operating under our local business ordinance with no apparent hardhsip or complaint. In fairness to these two organizations, and in I order to be consistent, it would seem difficult to make an exception in this particular. case.
