J 1 X77 Councilman Weymouth suggested that consideration be given to waiving the bonds on this type of business and to set a•smaller license fee. Councilman Weymouth moved to refer this matter to the City Manager for a recommendation, seconded by Councilman Stout and carried. The City Attorney reported that he had an ordinance ready for introduction in regard to the transferring and appropriating the sum of $11,250 from the unbudgeted reserve of the General Fund to certain stated departments purposes; appropriating the sum of $293.38 from the Capital Project Fund to Capital Improvements to the Training Building, Community Park; and appropriating the am of $13,000 from the Yacht Harbor Improvement Fund, and $1,937.23 from the 1944 Bond Fund for Capital Improvements to Yacht Harbor. Councilman Weiss offered introduction of the ordinance, striking out the last two sections of the ordinance in regard to the appropriations for the Yacht Harbor, seconded by Councilman Stout. Council- man Herkner, as chairman of the Yacht Harbor Committee, did not approve the deletion to the ordinance. This was followed by discussion. Councilman Spillers made an amendment to the motion to adopt the ordinance in whole. This was followed•by discussion and it was decided' to vote on the original motion. There wasn't any second to Councilman Spillers motion. The City Attorney discussed the matter and then Councilman Stout withdrew his second to Councilman Weiss's motion. Councilman Spillers moved to intorduce the ordinance as prepared by the City Attorney, seconded by Councilman Weymouth and carried, Councilman Weiss voting NO. Councilman Spillers offered RESOLUTION 2241 APPROVING CHANGE ORDERS IN CONNECTION WITH CONSTRU6TION OF REDWOOD CITY POLICE STATION and moved its adoption4 seconded by Councilman Herkner and carried on roll call, Councilman Granger being noted absent. CONTINUATION CITY OF SAN CARLOS REGARDING PORTIONS OF LOTS 1, 2, 3 AND 4, 'MAP OF EATON AVENUE VILLAS, Councilman Stout moved that this matter be referred back to the City Manager and he advise the people of the letter received from the City of San Carlos (the people in the area and the property owner), seconded by Councilman Herkner. Councilman Spillers stated that the people in the area lived on one-half acre lots and they objected to Mr. Toffanelli's property being allowed to annex to San Carlos because they are afraid the lots will be split into smaller lots than are allowed in Redwood City. Mr. Toffanelli addressed the Council and stated that he has had the property for the past eleven years and he has -not been able to buil& on it because he could not get sewers. This was followed by discussion with the Mayor telling Mr. Toffanelli what the Council had discussed at the study meeting in regard to the size of the lots which the people in the area were concerned about. There was also discussion in regard to the'possibility of deed restrictions and subdivision of the lots, the possibility of receiving sewers from San Carlos with the understanding of a gentlemen's agreement that the property would be allowed to annex to San Carlos after the subdivision map and deed restrictions were approved by the Redwood City Council. If Mr. Toffanelli were allowed to annex to San Carlos before the subdivision map was recorded, he would be allowed to resubdivide his lots into three lots with 8,000 sq. ft. each and five lots with 5,000 sq. ft. each. Redwood City has a limit of 6,000 sq. ft* per each lot. This was followed by discussion in regard to the possibility of allowing a nine lot compromise and leaving the matter to the Planning Commission for recommendation. The nine lots was the suggestion of Councilman Spillers in order to protect the people in the area. Councilman Herkner withdrew his second to the original motion. Councilman Weiss moved to refer the matter to the Planning Commission with a copy of the minutes to be referred to them also, seconded by Councilman Stout. After some discussion the motion was withdrawn and then put back into motion. The City Attorney reminded the Council of the street assessment bonds which have to be paid off before the de -annexation would be allowed. The Mayor stated that this was
