Councilman Britschgi moved that this matter be returned to the <br />Planning Commission for further consideration and asked that the people in the area be notified, <br />i <br />seconded by Councilman Spillers. City Attorney asked that this be continued on the agenda and still <br />refer the matter to the Planning Commission and ask them to report back to the Council. Councilman <br />j <br />j Britschgi amended his motion to carry this on the Council agenda until March 19th and still notify the <br />Planning Commission to reconsider the matter, seconded by Councilman -Spillers and carried. <br />PUBLIC HEARING, PLANNING C0181ISSION DENIAL DALE STUART APPLICATION TO REZONE LOT 71 BLOCK F, WOODSIDE ACRES <br />(1630 Union) FROM R-2 to R-3. Affidavit.of mailing was ordered filed. There'were no written protests. <br />iW* .Dale.Stuart spoke in favor of the rezoning as forming a buffer zone and he referred to the January <br />10th minutes of the Planning Commission as a possible enlightment on the situation. There is over <br />j 371000 square feet to the property in question. This was followed by discussion in regard to the <br />i <br />present zoning in the area. Councilman Britschgi moved close of public hearing, seconded by Councilman <br />i <br />Royer and carried. <br />Councilman Britschgi moved to overrule the Planning Commission's recommendation for denial and approve <br />the application, the City Attorney to prepare ordinance to rezone, seconded by Councilman Spillers. <br />This was followed by discussion as to why the Planning Commission voted rezoning. Motion carried on <br />roll call. <br />PUBLIC HEARING, PLANNING COMMISSION DENIAL OF M. CANCLINI APPLICATION TO REZONE PORTIONS OF LOTS 8 & 10, <br />BLOCK G, WOODSIDE ACRES (1584 Gordon) FROM R-2 TO R-3. Affidavit of mailing was ordered filed. There <br />were no written protests. Mr. Canclini, son of the owner, stated that their property was 1051 x 2751 <br />and all they wanted was permission to build another home on their property. His parents live in the <br />present house and wants to build a home on the back. They will deed to the City a 27+.strip for any <br />furture street which might divide the property in case of a street between Union and Gordon. Councilman <br />Royer asked the City Attorney if there was any way in which the Council could grant permission for the <br />second home without rezoning, possibly, by granting a variance. City Attorney Currie stated that they <br />could not grant a variance in this case, however, they could sign a Declaration of Restrictions. <br />Councilman Royer moved close of public hearing, seconded by Councilman Spillers and carried. <br />Councilman Royer moved that the property be rezoned to R-3 with the understanding that the City Attorney <br />prepare a Deed of Restrictions restricting the property owners to building of two homes, seconded by <br />Councilman Britschgi and carried. <br />PETITION WITH APPROXIMATELY 600 NAMES WAS TURNED IN REQUESTING TRAFFIC SIGNALS AT HUDSON AND WOODSIDE ROAD. <br />The Clerk read the petition. Councilman Stout asked if the Traffic Fact Finding Committee had made <br />any studies in regard to this matter. Chief Faulstich stated that this was done about two or three <br />years ago. Councilman Spillers moved that this be turned over to the Traffic Fact Finding Committee <br />for consideration and to notify the State and ask permission to erect some. City Attorney Currie stated <br />that the Council should state just what portion they are willing to bear before notify:.ng the State. <br />Motion seconded by Councilman Royer and carried. <br />INTRODUCE ORDINANCE REGARDING SUBDIVISION OF LESS THAN FIVE LOTS. Councilman Britschgi was of the opinion <br />j that the Council should hold up on this until after the study meeting. City Attorney stated that this <br />wasn't necessary as this was an amendment to the subdivision or dinance relative to subdivision of less <br />i <br />than 5 lots. This was followed by discussion after which Councilman Stout offered introduction of <br />ordinance, seconded by Councilman Spillers and carried on roll call.
