At the Brewster Pumping Station, installed a 40 h.p. pump and motor with pump control valve, and modernized the electrical panel board equipment for both the 40 h.p and 25 hep, units, in addition to increasing the size of the supply lines from the Brewster Reservoir to the Brewster pumps. 2. At the Vista and Oak Pumping Station, installed 6" and 8" cast iron water lines within the reservoir property to replace the old 4" line supplying the two (2) wooden tanks and pumping units; Installed the necessary fittings at this pumping station to permit the use of a gasoline powered pump in the event of a power or pump failure at this site. 3. At the Million Galloh Lakeview Reservoir site, installed a new 8" suction or supply line to the two (2) pumps. Also installed two (2) new pumps and motors, one (1) 10 h.p. and one (1) 15 h.p. with new electrical control panel board. Also repaired wooden roof framing and installed a complete new tar and gravel roof on the Million Gallon Reservoir. 4. From the Million Gallon Reservoir to the California Storage Tanks, installed a new 8" cast iron pumping line. 5. At the California Pumping Station, removed two (2) old 25,000 gallon wooden tanks 71 and installed one (1) new 50,000 gallon wooden tank. Also installed two (2) new 15 h.p. motors at this station and a 6" cast iron pumping line from the California Station to the Easter Cross storage tank. 6. At the Easter Cross storage tank site, removed one (1) old 25,000 gallon wooden ng tank and installed one (1) new 50,000 gallon redwood storage tank with necessary connections. Also installed cyclone fencing around this site. ed 7. The Redwood City Water Department also installed, at its own expense, seven (7) fire hydrants on the Emerald Lake pumping supply lines. 8. On the Hillcrest or Welbanks Storage Reservoir site, installed one (1) new 30,000 gallon wooden tank with connections. H. L. Winter, Water Superintendent Councilman Weiss moved that the reports be accepted and asked that a second supplemental report be made by the City Manager as to the expenditure of the major items which compromise the "Investment of Fixed Capital". This was*follared by discussion. Auditor Brophy stated that he could give the answer to Councilman Weiss if he would come into his office. He stated that in reading the report and analysis thereof reveals that some $92,137.88 have been expended on Capital Improvements and Fixed as Capital Investment since 1949. It was his thought that a supplemental report l 9 should be had to deliniate more specifically the types of improvements and fixed J C' capital improvements with appurtenant costs, etc. Councilman Herkner seconded the motion which carried. The Clerk read the following j report& This office has been requested for an opinion on the question of whether or not the I City is empowered to offer a --reward for the apprehension and conviction of the JI person or persons responsible for the demolition of the Civil War monument in ON Union Cemetery. Although the City of Redwood City is a chartered city and as such has complete authority and power with respect to matters of local concern, the apprehension and y conviction of persons violating the criminal laws of the State as opposed to local ordinances or regulations are held not to constitute matters of local concern. ie Griffin v. City of Los Angeles, 134 Cal App 763 at 772; Robert V. Police Court, 148 G Cal 131. Therefore it is held that a municipal corporation has no power, unless expressly authorized, to offer regards for the arrest and conviction of offenders RESO against the criminal laws of the State. Los Angeles v. Gurdane, 59 F 2d, 161; 3 McQuillin Municipal Corporations, Sec. 11.06, p. 10; see also 2 Atty. Gen. Opinions, 509; 4 Atty, Gen, Opinions, 201. In the destruction of the monument in question, no offense against local ordinances or regulations was committed. The offenses committed constitute violations of the j Penal Code of the State of California. t It is the opinion of this office that the power of the City to offer a reward under the abovementioned circumstances is doubtful. This office has also been requested to render an opinion on the power of the City to appropriate and expend moneys for the reconstruction of the abovementioned monument in Union Cemetery. The erection of monuments and memorials in public places upon public property constitutes a public purpose. Slavich v. Hamilton, 201 Cal 299. The specific type, location, and character of such monuments are questions of purely local concern and as such constitute local municipal affairs under the jurisdiction of the City. iThis office is informed that the record title ownership of the property included in Union Cemetery is presently vested in the State of California and therefore such property constitutes public property. Under the abovementioned circumstances, it is the opinion of this office that sub- ject to the consent of the appropriate department of the State of California having jurisdiction of the Cemetery, the City may appropriate and expend moneys for the reconstruction of the abovementioned monument or contribute moneys to a public fund for such purpose. s,l Councilman Granger moved that the City Man eger again be ins tructed to check into the cost of fixing the statue back into its regular form if it is possible and he also moved to accept the report of the City Attorney, seconded by Councilman Stout and carried.
