1. Definitions. For purposes of this agreement, the following words and terms <br />shall have the meanings respectively ascribed thereto: <br /> <br />a. "Abandoned Shopping Cart": a Shopping Cart which has been removed from the <br /> Premises of the Owner of the Shopping Cart without the Owner's written consent, <br /> irrespective of whether the Shopping Cart is located on private or public property; <br /> provided, that Shopping Carts which are removed from such Premises for purposes <br /> of repair or maintenance and which are in the possession or custody of the party to <br /> whom they have been released, shall not be deemed abandoned; provided, further, <br /> that a Shopping Cart located on private property owned or occupied by the person <br /> who has been granted written permission by the Owner of the Shopping Cart to have <br /> possession thereof for a period not to exceed seventy-two (72) consecutive hours, <br /> and which Shopping Cart is not visible at street or ground level from the public <br /> property adjacent to such private property, shall not be deemed Abandoned. <br /> <br />b. "Center": City's Public Works Services Center, located at 1400 Broadway, Redwood <br /> City, CA 94063. <br /> <br />c. "City": hereinabove defined. <br /> <br />d. "Contractor": hereinabove defined. <br /> <br />e. "Director": the Director of Community Development, or his or her designee. <br /> <br />f. "Holidays": the Thursday in November appointed as Thanksgiving Day in the State <br /> of California; December 25, January 1, April 23, 2000, and (if applicable, during the <br /> renewal term) April 15, 2001. <br /> <br />g. "Laundry Cart": a basket which is mounted on wheels and used in a coin-operated <br /> laundry or dry-cleaning retail establishment by a customer or an attendant for the <br /> purpose of transporting fabrics and the supplies necessary to process them. <br /> <br />h. "Non-Participating Owner": an Owner who or which has not entered into an <br /> agreement with City to participate in City's Shopping Cart Retrieval Program. <br /> <br />i. "Ordinance": Article VIII (Abatement of Abandoned Shopping Carts) [commencing <br /> with §14.115] of Chapter 14 of the Code of the City of Redwood City, as said Article <br /> exists upon the date hereof and may from time to time be amended, revised, or <br /> superceded. <br /> <br />j. "Owner": the person, firm, partnership, corporation, association, or other entity who <br /> or which owns, or otherwise exercises possession and control over, Shopping Carts <br /> for the use of the Owner's customers in connection with the management and <br /> operation of the Owner's business enterprise, including any officer, employee, or <br /> agent of said person, firm, partnership, corporation, association, or entity. <br /> <br /> 2 <br />Agmt-321 <br />DES:~g <br />F/shared'shared/Redwood/Council <br />02/07/00; 03/06/00 <br /> <br /> <br />
