Legislation (information only) - This sub - section involves possible discussion of
City Position on Proposed Legislation described in the League of California
Cities Priority Focus Bulletin No. 41 -2004 and 42 -2004. Council may direct staff
to act on positions taken by Council. (Copies of League of California Cities
Priority Focus available in City Clerk's Department)
B. Measure Q Update - City Attorney Stan Yamamoto
City Attorney Yamamoto stated that questions had arisen with respect to
Measure Q and the aftermath of the vote. He gave the background dating from
June 2004 when Council introduced an ordinance that rezoned the property in
the Bair Island area. The ordinance did not go into effect because in August 5,
the Council took action to place the ordinance on the November 2 ballot. Once
placed on the ballot, the ordinance remained suspended until the outcome was
known with respect to the General Municipal Election. Although the official count
is not known until the certified results are complete, the raw vote indicates that a
majority of the voters have not approved the adoption of the rezoning. After the
canvass of votes, should the results hold, under 9241 of the State Elections
Code, the ordinance remains in suspense for a period of one year. At this point
in time there is no action to be taken by the City Council with respect to rezoning
of that property.
Council comments included support of Mayor Ira's outreach to the "No on
Measure Q" Committee and the recommendation that there be a task force to
decide the best use of the site. The suggestion of a joint session with the
Planning Commission and Housing and Human Concerns Committee to discuss
housing in general was made. Where and what type of housing is needed, how
the Downtown Area Plan, the Marina plan and the General Plan fits in. Develop
some sort of guideline for proposals. The next study session in one of the
neighborhoods on the General Plan is scheduled for December 7 and the
CITY COUNCIL AND REDEVELOPMENT AGENCY
JOINT MEETING MINUTES
NOVEMBER 8, 2004
PAGE 7
MINUTES Book No. 60
Page No. 350
