2(b)5 Revisions to Work <br /> <br /> a. The DB, after describing proposed changes or revisions to the City and <br /> <br />receiving a written change order for the changes or revisions, shall make any necessary <br />changes or revisions to its Work, at no additional cost to the City, to ensure delivery to the City <br />of fully functional facilities which meet or exceed all functional, program and performance <br />requirements of the Request for Proposals, and any and all provisions of the DB's accepted <br />Proposal which meet or exceed the minimum requirements of the Request for Proposals. <br /> <br /> b. The DB shall revise its drawings, specifications, or other documents, at <br /> <br />no additional cost to the City, when such drawings, specifications or other documents are <br />inconsistent with the Request for Proposals, the accepted Proposal, and/or applicable codes, <br />laws and regulations; when such revisions or corrections are required to obtain required building <br />and other permits; or when such revisions or corrections are required due to errors or <br />deficiencies in the DB's designs, drawings, specifications, reports or other services. <br /> <br /> 2(b)6 Subsurface Conditions <br /> <br /> a. For all unknown hazardous conditions, natural conditions, and all non- <br /> <br />natural conditions, any increase or decrease in cost, whether for design or construction, or time <br />for performance resulting from such hazardous and unknown non-natural conditions shall be the <br />sole responsibility of the City, and this Agreement shall be modified accordingly to reflect any <br />increased cost or time for performance to the DB. <br /> <br /> b. Known natural and hazardous conditions are defined as those described <br /> <br />in the preliminary geotechnical report known as the "Geotechnical Investigation, Proposed New <br />Fire Station No. 11", prepared by Bay Area Geotechnical Group and dated March 5, 1999, and <br /> <br />Agmt-247 <br />F/sWsWRC/Council <br />FXS:rg <br />03/29/99R;O4/OS/99R, 04/07/99R <br /> -12- <br /> <br /> <br />
