conditions, and specifications pertaining thereto (the "Contract Documents"), which documents <br />are incorporated herein by this reference as if fully set forth herein. <br /> <br /> All drawings and specifications shall be prepared under the responsible charge <br />of an architect, and engineer, or structural engineer, as specified in writing by the City, in privity <br />of contract with the DB and by the City Engineer or its designee, who shall sign all drawings and <br />specifications for approval of the City. Observation of the work of construction shall be under <br />the general responsibility charge of the same architect, and engineer, or structural engineer <br />when feasible, as determined by the City, and of the City Engineer, or its designee. <br /> <br /> 2. WORK PERFORMANCE; RESPONSIBILITIES. (a) Work Performance: All of <br />the work to be done on the Project (the "Work") shall be done under the direction and <br />supervision of, and with and to the approval of, City or its authorized representative, and DB <br />shall cause the work to be done in a workmanlike manner, conforming strictly to the provisions <br />of the specifications and plans made therefor and within the time agreed upon by the parties. <br /> <br /> (b) Resconsibilities: DB shall be responsible to City for the act and omissions of DB's <br />agents, suppliers, employees, and Subcontractors, their respective agents and employees, and <br />those in privity with DB, for work performed under this Agreement. In addition to the <br />responsibilities set forth elsewhere in the Contract Documents, DB shall have the responsibility <br />for the following: <br /> <br /> 2(b)1. Site Conditions <br /> <br /> (a) Prior to Execution of this Aqreement: The DB will be held to have carefully <br />examined the Site and all Site conditions prior to execution of this Agreement. <br /> <br /> (b) Prior to Solicitation of Subcontractors' Bids: A.
