Item No. 1 (continued) <br />Ayes: Councilmen Britschgi, Greenalch, Stangel <br />Noes: Councilmen Bury, Chandler, LaBerge and Mayor Claire <br />M /S: Greenalch /Stangel to deny the application for Variance for the subject <br />property at 827 Fulton Street with staff to take steps to bring it into <br />compliance, and that it must be in compliance with all appropriate zoning <br />ordinances, as of May 1, 1988, the following findings being made: <br />a. There are no special circumstances associated with the parcel which <br />would allow the reduction of the lot size to less than half what is <br />required for a duplex. <br />b. The granting of a Variance would constitute the granting of a special <br />privilege by allowing an illegal dwelling unit constructed without a <br />Building Permit to remain. <br />c. The granting of the Variance would be contrary to the intent of the <br />Zoning Ordinance by allowing dwellings with inadequate parking, open <br />space, and setbacks. <br />The motion carried on the following roll call vote: <br />Ayes: Councilmen Britschgi, Greenalch, Stangel, and Mayor Claire <br />Noes: Councilmen Bury, LaBerge and Vice Mayor Chandler <br />MINUTE ORDER NO. 87 -63 <br />---------------------------------------------------------------------------- - - - - -- <br />2. Public Hearing, Parking Meter Rates (per RESOLUTION NO. <br />10459, 3/16/87: Finance Director Report 3/10/87) <br />(403 -03) <br />Affidavit of Publication of Notice of Hearings on file. <br />In response to questions, City Manager Smith and Finance Director Ramchandani <br />said that they understand that Council does not wish to change rates at this <br />time on the long term meters. <br />Mayor Claire declared the public hearing open at 8:20 p.m. and invited anyone <br />present who wished to speak to do so. No one wished to speak. <br />M /S: Stangel /Britschgi to close the public hearing <br />Carried unanimously by voice vote and public hearing closed at 8:21 p.m. <br />Title read.
