Item No. 5 (continued) <br />Mayor Claire invited anyone else present who wished to speak to do so. No <br />one else wished to speak. <br />M /S: Bury /Stangel to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 10:11 p.m. <br />M/S : Greenal ch /Stangel to approve the appeal by Brian Kangas Foul k on behalf <br />of Lincoln Property - PDP Seaport Center Unit No. 3 and PDP Seaport Center <br />Unit No. 4, subject to all conditions approved by the Planning Commission <br />with the following exceptions: <br />1. Condition 0., 2. (Unit 3), and Condition 0 (Unit 4), should be <br />deleted and the following revised par agr aph inserted after A. Soil s <br />for each unit of the subdivision: "the developer shall submit two <br />co pi es of a soil s report prepared by a C i v i l Engineer for review by a <br />geological consultant to be selected by the City. As in the previous <br />phases, the developer shall coo per at e in supplying any additional <br />data required for this review to be completed to the satisfaction of <br />the City Engineer, and the cost of this review shall be borne by the <br />devel oper. . The soils report submitted for review shall include the <br />results of the following based upon adequate soils test borings." <br />2. Condition C.4. and C.5.d. (Unit 3), and C.,l.d. and C.3.d. (Unit 4) <br />should be deleted. <br />3. Condition D.5., (Unit 4 only), Storm Drains should be deleted and the <br />following statement inserted: 'The portion of the storm drain <br />collector line which services phase 4 of Seaport Centre shall be <br />maintained by the maintenance district as was previously the case <br />with the collector line running between buildings 1, 2, and 3, in the <br />first phase of Seaport Centre.
