1. Public Hearing - Seaport Boulevard Landscape <br />Maintenance District (per RESOLUTION NO. 10534 6/8/87; <br />City Manager Report 6/4/87) (409 -04) <br />Report: City Manager 6/23/87 attaching Engineer's Report 5/4/87 <br />Bond Counsel Assaf stated that this is the public hearing on the formation of <br />the Seaport Boulevard Landscape Maintenance District; all notices have been <br />posted, published and mailed; the budget has been prepared; and the <br />Engineer's Report is on file. <br />Pete Bohl ey, Brian Kangas Foul k Associates (BFK), consulting engineers, <br />described the district boundaries and referred to overheads of a map and of <br />the Allocation of Costs and Methods of Assessment (See Exhibit B, RESOLUTION <br />NO. 10534, 6/8/87 with correction of typographical errors) . <br />Mr. Assaf, Mr. Bohley and City Manager Smith replied to questions concerning <br />details relating to items included i n the budget, noting that less than 100% <br />of the cost of some items is allocated to the District. <br />Mr. Smith reported that Pacific Gas & Electric previously contributed $10,000 <br />for the landscaping construction as a one time payment which would free them <br />from any future obligation, there being little or no benefit to PG &E. <br />Mayor Claire declared the public hearing open at 8:06 p.m. <br />Richard Gardel l a, attorney representing John and Mary Lyngso, referred to <br />their written protest dated July 17, 1987 which is on file. He urged the <br />City to use general funds to provide for what he believes are general city <br />benefits. <br />Don Tankl age, 44 Lana Road, owner of property included i n the proposed <br />District, referred to his letter of protest dated July 15, 1987, which is on <br />file. <br />Dan Levin, Lincoln Property Company, representing Seaport Centre, referred to <br />the map of the District, stating it was clear a maintenance district would <br />have to be formed to maintain the landscaping; that he believes everyone on <br />Seaport Boulevard benefits from the landscaping; and that some costs <br />allocated to the proposed District are for usual street requirements and <br />should not be included. <br />Discussion followed and Mr. Levin commented regarding the items he believes <br />are not a proper charge to the proposed District. <br />Mert Dil l ey_, Harbor Village Mobi 1 e Home Owners Association, inquired about <br />solutions to traffic problems. <br />Ray Ferrari, Ferrari Brothers, said that he does not object to landscaping as <br />he believes it has a favorable effect on land values, but had thought only a <br />one -time charge was involved. <br />Reg.Mtg <br />7/20/87 <br />Pa ge 2 <br />MINUTE BOOK NO. 47 <br />Page No. 198 <br />
