Item No. 3 (continued) <br />Dean Hemenway, 812 Peary Lane, Foster City, applicant, urged his request for <br />variance be granted, suggesting that sidewalk installation could be unsafe, <br />because his neighbors do not have it and objected to the five -year condition. <br />Vice Mayor Chandler invited anyone else present who wished to speak to do so. <br />No one wished to speak. <br />M /S: Greenalch /Bury to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 7:55 p.m. <br />Art Balsamo, former engineering employee of the City, responded to questions <br />about the subject area, stating that it was not possible to impose the City's <br />typical street section on the hill area and attempts had been made to design <br />a hill street section that would avoid the need for large retaining walls and <br />loss of property, but had not yet done so. <br />M /S: Brit schgi /Stangel to grant the subject variance without conditions and <br />without prejudice as to the City's authority under Chapter 29 of the Code to <br />require construction of improvements and with the finding that practical <br />difficulties and unnecessary hardships exist with regard to carrying out the <br />requirements of Chapter 29 in that the terrain of the area does not support <br />construction of the typical sidewalk section. <br />Carried unanimously by voice vote. Walker, <br />Applicant (Fox Hollow) (201 -02) <br />Report: Planning Commission record transmitted 7/23/87 <br />Affidavit of Publication of Notice of Hearing is on file. <br />Vice Mayor Chandler declared the public hearing open at 8:05 p.m. <br />David L. Walker, 107 Crescent Avenue, Portola Valley, applicant, asked for <br />approval of the proposed General Plan amendment and offered to reply to <br />questions. <br />It was pointed out that the item before Council for consideration is the <br />proposed change of the General Plan and not the specific development proposed <br />to be developed by the applicant. <br />In response to question, Mr. Walker said that there are 450 trees on the <br />10.602 acres where he would like to construct 12 single - family dwellings; <br />that he anticipates a loss of 36 trees over ten inches in diameter and some <br />smaller ones, not exceeding 10% of all trees in total; that only one -third of <br />the site would be visible from public streets; that the trees are considered <br />a valuable asset; and that little grading is planned for the private interior <br />streets because of their location. <br />Reg.Mtg. <br />MINUTE BOOK NO. 47 8/10/87 <br />Page No. 223 Page 3 <br />
