Item No. 1 (continued) <br />Hugh Cunningham, real estate representative for ARCO Petroleum Products, said <br />that the space to be provided for the proposed beer and wine products will <br />occupy only about 15% of the floor space, and they are expected to be <br />responsible for approximately 25% of sales income. Mr. Cunningham argued <br />that the "CP" District zone allows the Zoning Administrator to approve the <br />sale of alcoholic beverages there and that the new state law prevents the <br />City from prohibiting such sales as recommended by the Zoning Administrator. <br />He referred to the police record for the past two years at the ARCO station <br />at Woodside Road and Hudson, stating it suggests a good operation. <br />Peter Ales, 291 G Street, asked what community benefits ARCO provides. <br />Mr. Cunningham said that the ARCO Foundatioin offers funds to non - profit and <br />non - public agencies for certain activities and the funds are available by <br />application which must be reviewed. <br />Judy Buchan, 1126 Allerton, said that additional places to purchase liquor in <br />the subject neighborhood are not needed, stating that people buy it and take <br />it in bags for drinking in nearby Mezes Park. She urged the appeal be <br />denied. <br />Vice Mayor Chandler invited anyone else present who wished to speak to do so. <br />No one else wished to speak. <br />M /S: Britschgi /Stangel to close the public hearing. <br />Carried unanimously by voice vote and the public hearing closed at 7:55 p.m. <br />M /S: Bury / Britschgi to deny the appeal by ARCO Petroleum Products from the <br />decision of the Zoning Administrator in connection with approval of a Use <br />permit to allow a 24 -hour mini - market in conjunction with a gasoline service <br />station to attach the condition that beer and wine may not be sold at 504 <br />Whipple Avenue, the following findings having been made: <br />1) that the retail sale of beer and wine for offsite consumption at <br />this particular site is not permitted in the zoning district within <br />which the site is located; <br />2) that a service station with a convenience retail outlet at the same <br />intersection does not sell beer and wine for offsite consumption <br />and this denial would be consistent with that site's operations; <br />3) that a denial of beer and wine sales at this site is not inconsis- <br />tent with Business and Professions Code Section 23790.5 which is <br />added by the new chapter; and <br />4) that beer and wine sales for offsite consumption at a major entry <br />to Redwood City is not promotive of the purpose of the "CP" Zoning <br />District regulations and detracts from "pleasant appearance" <br />specified in Section 16.1 of the Zoning Ordinance, as a purpose of <br />the CP Zoning District. <br />Carried unanimously by roll call vote.
