7. Hamilton Way Lot Owners (Katie Lawler) request for <br />financial participation - Emerald Lakes Water Main <br />Extension <br />Report: Community Development Director 9/17/87 <br />In response to question regarding who pays for water main extensions in two <br />new Hills area developments, City Engineer Schroedl advised that costs are <br />borne by the developers. <br />In response to question regarding credit for installation of water main <br />extensions by individuals or developers, City Attorney Schricker advised <br />that while the question is premature, there is a legal vehicle for giving <br />credit which would be taken into consideration at the time any assessment <br />district is formed. <br />Katie Lawler 103 West O'Connor, Menlo Park, speaking for herself and Dav d <br />an Mary Borg of 172 North Spruce, South San Francisco, property owners in <br />the unincorporated area of Emerald Hills who request City participation in <br />the cost of construction of the water main extension needed to serve their <br />properties, asked how it might be possible to obtain that participation. Ms. <br />Lawler said that their concern is that if an asessment district is formed, <br />they will be assessed for lines for which they have already paid. <br />City Attorney Schricker again noted it is possible to provide credit for <br />households which have installed their lines. <br />In response to questions, General Services Director Sennewald said that the <br />neighbor of Ms. Lawler who did not have to construct an extension is located <br />where he was able to hookup to a different pressure area and that he paid <br />full price for the pipe serving his property; that the only benefit to the <br />system and the other ratepayers would be the theoretical one that the <br />Hamilton Way line would eventually be part of a "loop" which might be needed <br />in the future; and that the City has not paid for any other similar <br />improvements. <br />In response to question regarding a possible credit for construction of the <br />water main extension in the event of an assessment district, Mr. Schricker <br />suggested that such a credit would have to be well- documented and is <br />possible. <br />M /S: Britschgi /LaBerge to deny the request of Hamilton Way Lot Owners (Katie <br />Lawler and others) for financial participation by the City in the <br />construction of a water main extension to serve their properties in Emerald <br />Hills. <br />Carried unanimously by roll call vote. <br />Reg.Mtg. <br />9/21/87 <br />Page 5 <br />MINUTE ORDER NO. 87 -190 <br />MINUTE BOOK NO. 47 <br />Page NO. 367 <br />
