2. Public Hearing - Nuisance abatement, dilapidated <br />building - 1156 Cleveland (continued open from 8/26/85, <br />10/14/85, 10/21/85; Report of City Manager 10/17/85) <br />(702 -11) <br />Report of City Manager and Community Development Director 1/8/86 <br />In response to question regarding recourse of Council in the event the <br />earlier undesirable housekeeping practices are resumed by the Escobedo family <br />after the proposed rehabilitation loan has been granted, City Attorney <br />Schricker advised that judicial enforcement on such grounds is highly <br />unlikely. In further response to questions, Mr. Schricker said that the <br />City could foreclose on the property in the event of default in payments. <br />In response to question, Councilman Stangel, member of the Rehabilitation <br />Loan Committee, said that the value of the land is about $60,000 which, added <br />to the value of the rehabilitated house, would leave the property with a <br />total value exceeding the amount of the loan, thereby providing protection <br />for the City. <br />Mayor Britschgi declared the public hearing open at 7 :55 p.m. <br />Father Sean Corcoran, St. Dunstan's Church, Millbrae, formerly of Mt. Carmel, <br />urged that the proposed loan be granted to the Escobedo family, stating his <br />knowledge of the family and its background is such that he believes they will <br />make timely loan payments, maintain the property properly and be good <br />neighbors. Father Corcoran suggested that the present pastor of Mt. Carmel <br />Church where the Escobedo family are members and Sister Nina of that Church <br />would be willing to assist with any communication problems the family may <br />have. <br />Don Bryant, Legal Aid Society, also urged the proposed rehabilitation loan <br />be granted to the Escobedos, stating financial and other burdens have been <br />placed on them by illness and family problems, and suggested the City's <br />concerns about unacceptable housekeeping on the property have been met. Mr. <br />Bryant noted the Escobedos initiated the Neighborhood Board session in an <br />attempt to be good neighbors in the future. In response to question, Mr. <br />Bryant said that the Escobedos have no other property. <br />John Cooper, speaking for Neighborhood Boards, said that improvements have <br />been made and no further neighborhood problems are anticipated. <br />Mayor Britschgi invited anyone else present who wished to speak to do so. <br />No one wished to speak. <br />M /S: Chandler /Stangel to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 8:12 p.m. <br />M /S: Stangel /Claire to terminate the nuisance abatement proceedings with <br />regard to the Escobedo property at 1156 Cleveland Stret and approve a <br />rehabilitation loan in the range of $60,000 after the necessary application <br />and other forms have been completed and bids have been received. <br />Reg.Mtg. <br />MINUTE BOOK NO. 46 1/13/86 <br />Page No. 138 Page 2 <br />
