Item No. 3 (continued) <br />M /S: Claire /Chandler to endorse the Mid Peninsula Coalition Housing Fund as <br />the owner and purchaser of the shelter and the Emergency Housing Consortium <br />of Santa Clara County as the operator; and to thank the Housing and Human <br />Concerns Committee for their work and Councilman Rhodes for first bringing <br />the matter of the need for emergency shelter to the attention of Council. <br />CLARIFICATION: Councilman Claire said that it is implicit in his motion that <br />the next steps in the development of the Transitional Housing Facility will <br />be the selection of a facility and the development of a contract with the <br />City being provided with control over how the facility is operated and <br />specifying the conditions under which the City's contribution would become <br />due and payable. <br />The motion carried unanimously by roll call vote. <br />MINUTE ORDER NO. 86 -11 <br />---------------------------------------------------------------------------------- <br />(Council recessed from 8:50 to 9:00 p.m.) <br />---------------------------------------------------------------------------- - - - - -- <br />REPORTS OF CITY MANAGER <br />4. Extension of development on Laurel Way (Report of City <br />Manager and Community Development Director 11/26/85) <br />(201 -04) <br />Planner Patterson reviewed the subject report and recommendations of staff <br />with regard to development on Laurel Way. <br />In response to question as to how it is possible to consider allowing any <br />construction on an 8,000 square -foot site where, because of the steepness of <br />the slope, the Zoning Ordinance requires 51,000 square feet City Attorney <br />Schricker said that substandard lots were "grandf athered" in to the <br />ordinance, but other requirements have to be met, if a building is to be <br />constructed. <br />In response to question, City Attorney Schricker said that the City should be <br />expected to be named in any suit, regardless of any hold harmless clauses, in <br />the event of future landslides, if building on steep slopes is permitted. <br />Mr. Schricker noted that Council is considering a policy matter and that the <br />property owners can apply for building permits. <br />Don Maynor, 2471 East Bayshore, Palo Alto, attorney in behalf of Ben and <br />Marilyn Hatfield who wish to build a home at 3737 Laurel Way, referred to his <br />letter to Council of January 3, 1986, suggesting that three years ago they <br />were granted permission to build and would have done so if they had been able <br />to obtain financing. Mr. Maynor said that soils tests have been made <br />indicating the property can be safely developed and that Mr. Hatfield is a <br />builder of hillside residences who wishes to construct a home for his family <br />on the property. <br />City Manager Smith noted that a variety of reports would be required before <br />building on the site is permitted in any case. <br />Reg.Mtg. <br />MINUTE BOOK NO. 46 1/20/86 <br />Page NO. 148 Page 4 <br />
