Item No. 3 (continued) <br />Ruie Tomlin, 125 Hyde Street, neighbor of the appellants, said she is opposed <br />to allowing an outside separate staircase or inadequate parking. Ms. Tomlin <br />said she supports the conditions imposed by the Zoning Administrator and <br />asked that the appeal be denied. <br />Dean Collins, 90 Finger Avenue, said that the large tree on the Hummel <br />property would block any view the neighbors might have of the staircase which <br />he would prefer to a steel fire escape. Mr. Collins noted that parking is <br />poor on Finger Avenue. <br />Mayor Britschgi invited anyone else present who wished to speak to do so. No <br />one wished to speak. <br />M /S: Chandler /Bury to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 8:40 p.m. <br />M /S: Claire /Mosher to uphold the decision of the Zoning Administrator and <br />deny the appeal of conditions attached to the approval of a Use Permit to <br />allow an accessory dwelling unit within an existing single - family dwelling at <br />101 Finger Avenue owned by Stanley and Angela Hummel, based on the following <br />findings: that conditions of the Use Permit are approved in that they are <br />necessary to obtain the objectives of the Zoning Ordinance in that they <br />require compliance with Zoning Ordinance Section 2.5.2, and, further, that no <br />grounds have been established for granting a variance pursuant to Zoning <br />Ordinance Article 43. <br />The motion carried on the following roll call vote: <br />Ayes: Councilmen Bury, Chandler, Claire, Mosher and Mayor Britschgi <br />Noes: Councilmen Rhodes and Stangel <br />MINUTE ORDER NO. 86 -31 <br />4.
