Public Hearing - Appeal of conditions attached to the <br />approval by the Zoning Administrator of a Use Permit to <br />allow an accessory dwelling unit within an existing <br />single - family dwelling, 101 Finger Avenue - Stanley M. <br />Hummel, appellant (203 -06) <br />Report of City Manager and Community Development Director 1/24/86 <br />Appeal letter 1/17/86 <br />In response to questions, Planner Patterson said that the inside stairway <br />from the proposed accessory unit leads to a shared entry hall; that the plans <br />submitted by the appellant in 1982 for a family -room now proposed to be an <br />apartment indicated an outside staircase, but the staircase was crossed off <br />the plan for which the building permit was issued; and that with regard to <br />fire safety, the proposed unit would be no different than any other two -story <br />home and does not require a fire escape. <br />Mayor Britschgi declared the public hearing open at 8:12 p.m. <br />Stanley and Angela Hummel, 101 Finger Avenue, appellants, said that his plans <br />for the family room for which he received a building permit in 1982 included <br />an outside staircase. In response to statement that it was the intent of <br />Council when "granny" units were to be allowed in single - family neighbor- <br />hoods, that the exterior of the home should not appear to be that of a <br />multiple dwelling, Mr. Hummel said that he has concerns about fire safety and <br />would like to have the separate entrance stairway outside. <br />City Attorney Schricker said that no permit to construct an accessory <br />dwelling in a single - family zone (R -1) would have been granted in 1982, since <br />such units were illegal. Mr. Schricker said that now the Zoning Ordinance <br />has been amended to allow such units in R -1 zones, provided the neighborhood <br />character is not affected, noting that in any case the earlier application <br />was for a family room and not an additional dwelling unit. <br />Mrs. Hummel confirmed statements made by Mr. Hummel <br />Jon Pieroq, 79 Finger Avenue, said the proposed rental unit with an outside <br />staircase would be out of character with and have a negative effect on the <br />neighborhood.
