2. Public Hearing - Abatement of public nuisance, unsafe <br />buildings, 757 Douglas Avenue (702 -11) <br />Report: Chief Building Official and Community Development Director 4/10/86 <br />Affidavit of Posting of Notice to Abate Nuisance and Affidavit of Mailing are <br />on file. <br />Chief Building Official LaTorra, Building Inspector Garcia and William <br />Phoenix, attorney, were sworn by City Clerk Hildebrand with regard to <br />testimony to be given during the public hearing. <br />Chief Building Official LaTorra presented the subject report and photographs <br />depicting conditions on the property in support of the recommendation for <br />abatement of nuisance. In response to questions, Mr. LaTorra said that the <br />accessory building is an illegal structure; that the patio enclosure does not <br />meet requirements for habitation; that the main building could be <br />rehabilitated with extensive repairs; that the property owner was advised of <br />the conditions described in the report by the San Mateo County Health <br />Department in June 1985 and by the City several times since January 30, 1986; <br />and that there has been no cooperation from the executrix or her attorney in <br />correcting hazardous conditions and violations of the Uniform Housing Code <br />and the Zoning Ordinance. <br />Mayor Claire declared the public hearing open at 7:58 p.m. <br />William Phoenix, 3060 Broadway, attorney representing Mrs. Faye Harvey, <br />executrix for the subject property, said he was unaware of any problems with <br />the main building and that Mrs. Harvey has plans for modifying the accessory <br />building, if it is possible to obtain permits to do so. Mr. Phoenix said he <br />had not received the notices referred to by Mr. LaTorra. <br />Attention was called to the signed receipt for certified mailing to Mr. <br />Phoenix of the notice which covered both buildings and to the posting of <br />notice on both the main and the accessory buildings. <br />Mr. Phoenix asked that the matter be continued so that he might obtain more <br />information. In response to question, Mr. Phoenix said that Mrs. Harvey is <br />the executrix of the estate and will be the trustee for the sister of Danny <br />Daniels property owner, now deceased. <br />In response to request of City Attorney Schricker for designation of the <br />person responsible for the property, Mr. Phoenix said his client, Mrs. <br />Harvey, is responsible for the property and that contacts should be made to <br />Mrs. Faye Harvey at her business address at Harvey's Residential Care Home, <br />1330 Chilco Street, Menlo Park, California 94025. Mr. Phoenix asked that <br />copies of communications be given to him also, as her attorney. <br />Annie Edwards, 781 Douglas, neighbor of the property, reported that the <br />conditions described in the subject report and by Mr. LaTorra did not exist <br />when Mr. Daniels was living there, but that the deterioration has occurred <br />Reg.Mtg. <br />5/12/86 <br />Page 2 <br />MINUTE BOOK NO. 46 <br />Page No. 258 <br />
