Item No. 1 (continued) <br />Zoning Administrator Patterson presented overheads of exhibits in the subject <br />report and replied to questions related to the site of the proposed food <br />operation. <br />Mayor Claire declared the public hearing open at 7:37 p.m. <br />Jim Plemons, 158 South Palomar, part owner of Sudano's Deli at 2205 <br />Middlefield Road, and West Bay Realty, and one of the appellants, said he is <br />concerned about health code requirements with relation to the sale of food <br />outdoors and that a precedent is being set with regard to allowing outdoor <br />food sales in parking lots, suggesting it creates a bad city image. <br />Sal Sudano, 2449 Caroline Avenue, part owner of Sudano's Deli, said a food <br />cart business will have an adverse effect on his competing food business <br />across the street from The Price Club and urged approval of the appeal. In <br />response to questions, Mr. Sudano acknowledged that the appellants have not <br />protested to the County previously about health code requirements for other <br />outdoor businesses. <br />Hal Bryman, 4901 Marina Boulevard, San Diego, representing The Price Club, <br />said that a clearance regarding health code requirements was received from <br />San Mateo County for the foodcart operation before application was made to <br />the City for the subject Use Permit. Mr. Bryman said that the hot dog cart <br />is intended to be a convenience for persons leaving the store, that the food <br />served is available in bulk inside, that customers will not be encouraged to <br />linger because of the value of parking places, and that the cart operation is <br />not expected to draw any customers who are not already shoppers at the store. <br />Jim Plemons ( see above) said that unlike other pushcarts in the City, the <br />proposed food cart would not have to move every 15 minutes, and in response <br />to questions, said that some of his deli business is from Price Club shoppers <br />and that traffic from the store may also adversely affect his business. <br />Mayor Claire invited anyone else present who wished to speak to do so. No <br />one wished to speak. <br />M /S: Stangel /Britschgi to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 7:56 p.m. <br />M /S: Britschgi /Bury to uphold the decision of the Zoning Administrator and <br />deny the appeal of the approval by the Zoning Administrator of application by <br />the Price Company for Use Permit to allow sale of food from a portable cart <br />in conjunction with a bulk /retail facility, 2300 Middlefield Road - Jim <br />Plemons, Tom J.
