J, W. Riley was unable to perform both proiects at the seme time. He had overextended <br />his resources and had inadequate experienced staff to perform quality work on both <br />projects. This caused a long punch list of items to be corrected. The punch list items were <br />not promptly completed. <br /> <br />Proiect Scope of Service <br />The project will repair damaged sidewalk, driveway approach, and curb and gutter at any <br />location in the City where the property owners agree to pay one-half the cost of concrete <br />construction. There is no charge to the property owner for associated tree root pruning or <br />street paving. The contract includes the construction of wheel chair ramps as identified by <br />resident requests. The contract also includes the construction of concrete sidewalk, <br />driveway, and curb and gutter following repairs by the City's water and sewer utilities. <br /> <br />Staff has applied the direction from the City Council and Tree Policy Task Force in the <br />approach to this program. Tree work for the project will be coordinated and performed by <br />the City's tree maintenance staff or annual tree maintenance contractor as resources are <br />needed. Root pruning versus tree removal decisions will be determined on a case by case <br />basis, with the first priority being to preserve trees. When possible, the City will encourage <br />property owners to preserve the tree by allowing the Ci~ to establish a sidewalk <br />maintenance easement on private property for the relocation of the sidewalk. This creates <br />adequate space between the tree and new sidewalk to perform root pruning. <br /> <br />Some tree preservation designs may cause the elimination of on-street parking in front of a <br />property by relocating the curb and gutter around the tree into the parking lane. If a site <br />does not allow the relocation of a curb into the street area, staff may bypass the site and <br />perform a temporary repair to preserve a worthy tree. If a site does not require concrete <br />construction for safety, and a property owner does not allow the requested easement to <br />move the sidewalk farther from the tree for the distance necessary to perform root cutting, <br />staff may bypass the site and perform a temporary repair to preserve a worthy tree. These <br />exceptional circumstances will be communicated to the property owner during the cost <br />estimate offer for the work. <br /> <br />Alternatives <br /> · Accept the unbalanced Iow bid. If any additional change order work is added to the <br /> project, staff believes the overall cost of the project will be higher than the second <br /> bid. The unbalanced nature of the bid does not show the contractors true costs <br /> and may create hardships in performing underbid bid items. <br /> · Re-bid the project. The nature of the cost shared project with the unknown <br /> locations and geographical spread of the sites is not as desirable a project as the <br /> block-by-block sidewalk repair project. Staff has checked with potential bidders that <br /> did not bid on this project and they mostly likely will not participate in a re-bid of the <br /> project. <br /> <br /> Fiscal Impact <br /> Funds have been approved for appropriation in the FY 2002-2003 Capital Improvement <br /> Program, Tree Preservation and Sidewalk Repair funding and Wheel Chair Ramp <br /> Construction the amount of $1,000,000.
