Box 8567 <br />Emeryville, CA 94662 <br /> <br />SUBJECT: REJECTION OF BID FOR 2002-2003 COST SHARED SIDEWALK REPAIR <br /> PROJECT <br /> <br />Reference: Bid determined to be unbalanced <br />Dear Mr. Riley: <br /> <br />The bids for the subject project were opened on April 24, 2002. Three bids were received for the <br />project and opened in the office of the City Engineer. <br /> <br />Your bid was the apparent low bid. However, after staff evaluated the bids, your bid was found to be <br />greatly unbalanced. Staff finds that some of the bid items cannot be properly completed for the amount <br />of your unit bid price. This combined with review of your performance on two previous contracts with <br />the City, which experienced a failure to complete the contract and unacceptable delays in completion <br />of work, have resulted in the bid being rejected. <br /> <br />Based on Contract specifications Section 2.10 D. on page 00210-6 and 00210-7 of the General <br />Conditions, "Proposals in which prices are obviously unbalanced may be rejected by the City Council." <br />Staff determined that it is not in the City's best interest to accept this bid due to the unbalanced <br />preparation of this bid. <br /> <br />The City Council will be awarding the contract on the Project on Monday, May 20, 2002. Staff will <br />recommend to the Council that your bid be rejected and that the contract be awarded to the next lowest <br />bidder. This letter is to advise that you have the right to appear before the City Council before the award <br />of the contract and present any and all arguments that you deem appropriate regarding the rejection <br />of your bid. In the event that you decide to attend the Council meeting and present your arguments, I <br />would recommepd that you fill cut a Speaker Card and give it to the City Clerk or to Mr. Balsamo at the <br />beginning of thc meeting.
